PREPARATION FOR THE COURT CASE TO BE FILED AGAINST ILLEGAL WITHHOLDING
OF PART OF PENSION & PENSIONARY BENEFIT ARREARS

AIRBSNLEWA has decided to move to the court of Law against the illegal withholding of part of Pension and Pensionary Benefits. The proposed case will be filed at Principal Bench CAT New Delhi AFTER 31ST MARCH AND PAPERS WILL BE RECEIVED FROM PENSIONERS TILL 15TH MARCH 2017 . Since for this kind of cases the court extends the benefit only to the applicants, AIRBSNLEWA has decided to get the signature of as many pensioners/Family Pensioners as possible in the "Vakalatnama" so that all interested pensioners/ Family Pensioners can get the benefit thereof. Even Non Executives Pensioners/Family Pensioners also can be the applicant. Coming two months will be utilized to mobilize the pensioners and family pensioners (retired between 1-10-2000 to 09-06-2013) for the purpose:

23.03.2017:   Meeting with GM (Admn) BSNL CO: Com Prahlad Rai Chief Mentor and AGS (AIRBSNLEWA) Com Amit Gupta met GM (Admn) BSNL C.O. and discussed regarding-

(a) Night free calling facility to BSNL Pensioners on Sunday also:   We requested GM (Admn) to clarify to CGM ITPC to provide night free facility to BSNL pensioners on Sunday also and thanked him for extending this facility on other days on our request.

(b) 500 free calls in addition to general free calls to BSNL pensioners:  We requested to issue order for 500 free calls+ General calls available to BSNL pensioners instead of 500+50 free calls.  GM (Admn) assured to   look in to the matter.

(c) Empanelment of good/big hospitals also on cash payment basis on CGHS rates in case they do not agree  for cashless medical facility  GM(Admn) mentioned that already instructions are there to circles to empanel the good/big hospitals also on CGHS rates.  However he assured to reiterate the order.

(d)  Residential telephone connection to BSNL employees to their native place in place of their service station on their request:  We requested to allow to have residential telephone at the native station to BSNL employees on their request instead of their service station.  GM (Admn) assured to look in to the matter.

(e) BSNL mobile telephone to BSNL executives in Delhi NCR and Mumbai: We requested to provide BSNL mobile telephone connection to BSNL executives in the Delhi NCR and Mumbai area instead of MTNL to avoid disconnections.    Click for the letter submitted   << Letter>>

10.03.2017:   Meeting with CGM, ITPC Pune and GM (Admn), BSNL CO, New Delhi

Com Prahlad Rai our Chief Mentor met with CGM, ITPC Pune and GM (Admn), BSNL CO and discussed regarding:

A) Creating software for online submission of medical vouchers: He requested CGM, ITPC Pune who was on tour to BSNL CO in the presence GM (Admn) BSNL CO to create a software for online submission of medical vouchers.  CGMT ITPC mentioned that he has already submitted an estimate in this regard to the Admn. Cell of BSNL CO and after its approval the desired software will be prepared. GM (Admn) informed that some queries regarding expenditure has been made to CGM ITPC office. CGM ITPC assured to reply next week itself.

B) Free calls (500+220 calls) instead of (500+50 calls) to BSNL pensioners: He requested to revise the order in terms of 500+220 calls instead of 500+50 calls to BSNL pensioners to facilitate them. GM Admn assured to look into the matter.

Com Prahlad Rai our Chief Mentor met with GM (Admn) and discussed regarding BSNL Management Committee approval on Night Free Calling facility to BSNL Pensioners. GM (Admn) informed that the competent authority has approved this proposal and necessary orders will be issued shortly. Consistent efforts only by AIBSNLEA and AIRBSNLEWA thus yielded result in getting the proposal approved which was moved from Admn Section after the Directions given by Director (HR) in the informal meeting held with AIBSNLEA and AIRBSNLEWA on April 2016. This issue has been constantly pursued by AIRBSNLEWA and AIBSNLEA only since last 11 months.

07.03.2017:   Meeting with Member (S), Telecom Commission, DoT, New Delhi.

Com Prahlad Rai our Chief Mentor along with others, met with Member (S) and discussed regarding:

A Implementation of 3rd PRC Recommendations in BSNL: They requested for the implementation of 3rd PRC recommendations in BSNL with full fitment benefits. Member (S) informed that already a presentation was made to the group of Secretaries last month on this issue wherein DoT has pleaded for the pension revision of BSNL Pensioners just after the implementation of 3rd PRC recommendations for BSNL serving employees. Also pleaded for enhancement of gratuity of BSNL Pensioners from Rs. 10 Lakh to Rs. 20 Lakhs etc. However, on 10th March 2017 DoT is conducting its internal meeting wherein associated PSUs including BSNL will be giving their presentations in this regard wherein they have to justify that incase 3rd PRC recommendations are implemented with full fitment benefit in what manner the PSU will be meeting its losses. He further mentioned that  BSNL’s presentation is awaited but MTNL has already submitted its proposal. He assured that DoT will try to support the BSNL’s proposal in the Cabinet Secretariat.

B Enhancement of gratuity from Rs. 10 Lakh to Rs. 20 Lakhs for BSNL Pensioners: They requested for issuing the orders for enhancement of gratuity from Rs. 10 Lakh to Rs. 20 Lakhs for BSNL Pensioners from 01.01.2016. Member (S) informed that matter is under active consideration and shortly necessary orders will be issued in this regard.

Com Pallab Bose Circle Secretary, Com C.S.Verma Circle Finance Secretary AIRBSNLEWA UP (E) met jt.CCA UP on 23rd Feb 2017.They expressed  our concern  on delay in Revision of PPO’s and consequent HOLD-UP regarding payment of arrears of pension to around 9539 UP(East) BSNL Pensioners / Family Pensioners, who retired from BSNL between Ist October 2000 and 9th June 2013.
Circle Secretary Pallab Bose  told that the  after lapse of eight months of the issue of orders dated 18-7-16 , CCA Lucknow have received only  7216 cases out of 9539  case from different SSA’s of UP East Circle till 23.02.2017 as details given below;
1.Total  Pensioners in UPE :      9539
2. CCA received :                          7216
3. Yet to be receive from different SSAs: 2323 
4. Out of 7216 cases   4873 PPO's issued.
5. 2343 cases are under process.
6. 612 cases is in final stage & 151 PPOs are ready to dispatch as on 23.2.2017

GS, AGS (HQ) AIBSNLEA and GS AIRBSNLEWA met GM (Admn.) BSNL Corporate Office and discussed regarding:

A Night Free Calling facility for BSNL Pensioners.: They requested GM (A) for issuance of orders in this regard. GM (A) informed that the proposal of allowing Night Free Calling facility for BSNL Pensioners is under consideration of Management Committee of the BSNL Board. The MC has asked some queries which are being replied and shortly some decision will be taken in this regard.

B Online Tracking facility for payment of medical bills of the BSNL Pensioners: GM (A) informed that in this matter CGM, ITPC has been asked to send a revised proposal to prepare a software in view of its financial implications for approval from the competent authority. We requested for an early action in this regard.

03-01-2017  THE BENEFIT OF PENSION ANOMALY CASE IS EXTENDED TO THE APPLICANTS ONLY  
The Principal Bench of CAT New Delhi in its Judgment Dated 16-12-2016 on the Pension Anomaly Case of the BSNL Pensioners retired between 1-10-2000 and 30-06-2001 (OA 2173/2014) extended the benefit only to the 12 applicants although the case was filed by AIBSNLPWA on behalf of 4230 affected pensioners on representative capacity.

We have been criticised for involving each and every pensioners as applicants of the present "denial of pension and pensionary benefit cases" by the self styled experts. This Judgment shows that we are in right track, and for ensuring the benefit the pensioners have to be the applicants of the case individually.
Therefore we again request all, not to be misguided but become party of the case being prepared by this Association.

  27.12.2016:    Circle Executive body of UP (East) met with CGMT

Our Circle Executive body of UP (East) Circle had a meeting with Shri T.N.Shukla CGM UP East on 27th December 2016 in his chamber. The meeting was attended by the CGM, & GM (NWP-CFA).& from Association side Com S.M.Abbas Circle President, Com Pallab Bose Circle Secretary, Com C.S.Verma Circle Finance Secretary AIRBSNLEWA UP (E).  .

Discussion was held on delay in Revision of PPO’s and consequent HOLD-UP regarding payment of arrears of pension to around 8524 UP(East) BSNL Pensioners / Family Pensioners, who retired from BSNL between Ist October 2000 and 9th June 2013

Circle Secretary Pallab Bose told the Hon’ble CGM that total 8525 BSNL pensioners retired between October 2000 to 9th June 2013 out of which approx.1800 are Executives. In UP (East) Circle is waiting for revision their pension after 78.2% IDA merger. Further he told that the  after lapse of five months of the issue of orders dated 18-7-16 , CCA Lucknow have received only  4210  cases out of  8525  case from different SSA’s of UP East Circle till 20.12.2016. This is approximately 50% of total Pensioners of BSNL UP (East) Circle.

We further informed to CGM UP East that work progress of some SSA’s are worse due to their ignorance towards BSNL Pensioners. These include GMTD Varanasi, PGMTD Lucknow, CTSD Lucknow, GMTD Kanpur, GM Mobile Lucknow, GMTD Sultanpur, GMTD Jhansi, GMTD Lakhimpur, GMTD Mirzapur, GMTD Deoria, TDM Pratapgarh, TDM Ghazipur, Gonda, Raibareily, Bahraich, Banda, Fatehpur, Hamirpur, Jaunpur, Mau, Sitapur, Ballia, Unnao, Farrukhabad etc. We have provided the Detail list of worse SSA’s along with our protest letter address to CGM Up East Circle.

Lastly we have requested to Hon’ble CGM to look into the matter and arrange for expeditors and timely revision of PPO’s for payment of revised Pensioner / Family Pension before 31-12-2016 as targeted/proposed by DOT in OM dated 16th July 2016.

24.12.2016:           Meeting with Dy CCA UP(East) Circle Lucknow.:
Com Pallab Bose CS , Com C.S.Verma Finance Secretary & Com R.N.Singh Auditor of AIRBSNLEWA UP East Circle met Dy.CCA Uttar Pradesh Lucknow on 21.12.2016 for finding the progress of 78.2% IDA merger issue and consequent pension revision It has been learnt that only about 4218 pay fixation memos & pension sanction memos out of 8524 have been received by them from different SSAs, which is approx 50% of the total figure. We further learnt that Out of 4218 cases , 2550 cases have been disposed by CCA UP East as on 19.12.16 and their revised PPO letter is being posted by speed post.
Progress of some SSAs is worse due to their negligence towards BSNL Pensioners. These include: GMTD Varanasi, PGMTD Lucknow, GMTD Kanpur Sultanpur, Jhansi, Mirzapur, Deoria, Pratapgarh, Ghazipur, Gonda, Raiberily, Bharaich, Banda, Fatehpur, Hamirpur, Mau, Jaunpur, Ballia, Unnao.

On this issue they had met with CGMT UP(East), PGMTD Lucknow, DGM(Finance) Lucknow TD, several times in the past and had pointed out the provision of the DOT/BSNL order that the 78.2% IDA merger issue has to be completed by 31-12-2016.Insider sources have speculated that CCA have been reportedly asking for a date extension from D.o.T on this issue and want it extended to March, 2017 as SSAs are not co-operating. All Pensioners/District Secretaries AIRBSNLEWA of above SSAs are requested to pursue their 78.2% IDA merger issue at SSA label.immediately.

  20.12.2016:     Pensioners of West Bengal Telecom Circle Pl Note that CCA WB Circle has decided to send sanction memo of pension revision cases to the units concerned (wherefrom the cases were received) alongwith the copy of pensioners (since PINCode of all the pensioners are not available). Pensioners are therefore requested to collect their revision of pension sanction memo from the units wherefrom the cases were forwarded to CCA office.
07.12.2016:  Com Kishan Singh writes to Secretary DoT on abnormal delay in implementation of 78.2% IDA merger for pensioners. <<Read>>   
30.11.2016:   About 30 cases are returned by CCA West Bengal for improper bank details. <<<list>>> . All are pre 2007 cases. Concerned pensioners may kindly meet DGM(F) Circle Office. Post 2007 cases received by CCA WB are ok and being processed. About 120 cases are already settled for which sanction memos are issued. 
25.11.2016:        SHAME     SHAME    SHAME  
The ARMCHAIR people have again awaken from their long nap. This time they alleged that in the name of Court Case we are trying to cheat the pensioners for making money for ourselves. They also alleged that  earlier we have congratulated and welcome the order and now we are going against it. Pensioners may see our old news and find that only this Association has written a letter on 13-06-2013 i.e 3rd day of the issue of order to secretary (T) for taking action for the pensioners. <<<view the letter>>>. As regards collecting money for ourselves, such heinous allegation at this stage of life is possible only by those who have mustered the art of swallowing not only Association money but also the three storied building worth 3 crores. By making such statement they are only demonstrating their class to the pensioners. We feel pity for these people.
22.11.2016:   It is most unfortunate that some of our pensioner friends are propagating against the proposed court case saying it will stop the present process of implementation of 78.2% IDA merger
Although it is mentioned in the circular, still it is again reiterated that

THE SAID CASE WILL BE FILED ON SOME DATE ONLY AFTER 15 JANUARY 2017.

It may also be noted that the official last date of implementation is 31st Dec 2016 after which the order stands officially implemented.
What is being done now is only preparatory work, which require considerable time.

1) Extension of Night Calling Facility To Concessional Telephones: As proposed by our Association the issue is now in Final stage and will be put up before the management committee next week and after the approval order will be issued.

Tracking Module for medical Bills : As per our proposal the module is finalized and will be launched by CMD BSNL shortly.
  
07.11.2016:  Reply from DoP & PW on RTI querry made by Com Amit Kumar Gupta AGS.   
Com Gupta has submitted a RTI querry to DOP&PW on 07-09-2016 asking applicability of the paragraphs 2.1 and 7(a) of its OM no DoP & PW vide O.M. F.No.38/37/2016-P&PW(A)(ii) dated 04.08.2016 on implementation of 7th CPC, which reads as below  <<<Read the Application>>>
para 2.1, These orders shall apply to all pensioners / family pensioners who were drawing pension / family pension before 01.01.2016 under the Central Civil Services (Pension) Rules 1972.
para 7(a) The cases of Central Government employees who have been permanently absorbed in public sector undertaking / autonomous bodies will be regulated as follows:-

When the Government servants on permanent absorption in public sector undertaking / autonomous bodies continue to draw pension separately from the Government, the pension of such absorbees will be updated in terms of these orders

22.10.2016:   AIRBSNLEWA UP(E) meets Addl GM UP(East) :On 19th October 2016 Com Pallab bose CS along with Com C.S.Verma Finance secretary & Com R.N.Singh Auditor met Sh H.R.Choudhary Addl. G.M UP(East) Circle on 18-10-2016 at his chamber and discussed the issue of 78.2% IDA merger from 1-1-2007 and consequent pension revision. We pointed out the provision of the order that the Job has to be completed by 31-12-2016. We requested him to issue a letter to all SSA heads for early sending of pension cases with the service books of their pensioners and fixation memos along with prescribed Performa with a time limit so that the time frame given by DOT materializes. Circle Secretary Com Pallab Bose mention that, procedure of working in our Circle is not satisfactory. We have clearly told that delay tactice of Circle pension cell will not be be tolerate by our Association. Shri H.R.Choudhary Addl G.M.(Admn) appreciates our concern for pension arrear of BSNL pensioners & assured to take necessary action and also said that he himself and PGM (Admn) will speak to CCA UPE regarding this issue. He immediately instructed to his his pension cell to issue a letter to CCA UPE & all concern with necessary instruction.
The whole issue was discussed in detail with at length for about one hour in a very congenial atmosphere and assurance of Addl G.M.(Admn) was very positive.
22.10.2016:    INCREASE OF GRATUITY FROM 10 LAKHS TO 20 LAKHS. Com Kishan Singh GS met DDG(ESTT) DOT yesterday and discussed about raising the gratuity limit to 20Lakhs as per 7th CPC recommendations TO BSNL pensioners retired after 1-1-2016. DDG (Estt) Sri S K Jain informed that the issue is under consideration.

He also Met in PFP section DOT for entry in PPO as per DOT order No4-12/1/2012 – PAT (pt) Dt. 18.10.2016 for C.G.H.S card it was informed that work will be started soon.

Then he met GM (A) in BSNL C.O about s/w developed by ITPC Pune for medical reimbursement of pensioners for it's date of inauguration. It is told that this may be done before Diwali and information of date will be given.

About night free calls facility to pensioner on concessional telephone, some queries have been raised which will be replied soon.

22.10.2016:  DOT issues further clarification on Extension of CGHS facilities to MTNL/BSNL pensioners for determining Grade Pay and Ward entitlement.  <<<< ORDER>>>>
22.10.2016:  Yesterday Circle office Bearers of West Bengal Circle Met CCA & Deputy CCA CTD for finding the progress of 78.2% IDA merger issue. It is learnt that only about 700 service books are received by them which is only 12% of the total figure. They requested to issue a reminder to CGM CTD for expediting the work. It is also learnt that the cases received will be settled in FIFO basis. Copy of the revised PPO issued to the BANK will also be send to the concerned pensioners simultaneously.

Next they had a meeting with PGM CTD and discussed
 1 ) Empanelment of Hospitals on Cash Basis Treatment at CGHS rate as per BSNL CO order.
 2)  Inclusion of 17 more hospitals in the approved list of 233 Hospitals.
 3)  Issuing guidelines to the areas for following uniformity of rules on various points.

PGM agreed on all the points and instructed to process the issues. 

19.10.2016:   ORDERS ARE ISSUED BY West Bengal Telecom Circle : As reported by us yesterday, as a follow up action of our yesterdays SIT IN STARVATION and the decisions taken in the subsequent meeting with the CGM, WBTC today issued two letters one addressed to our Association and other to All SSA heads. The decision of stopping of collecting written information from pensioners has not mentioned in the letters. We have pointed out the same and expect  a corrective letter tomorrow. <<<<<< Click for the letters>>>>>
18.10.2016:  ANOTHER GREAT VICTORY FOR AIRBSNLEWA TO THE CAUSE OF PENSIONERS  :
As notified the SIT IN STARVATION program started before CGM WBTC sharp at 10 AM today to protest against  inaction to implement 78.2% IDA merger work and non payment of Medical Bills since February 2016. As We just started the SIT IN program, Senior GM (F) Mrs Rupa Paul Chaudhury came to the corridor and requested us not to sit in the corridor as she fell ashamed to see the seniors in this condition. She requested to come and sit us in her chamber instead. We politely refused and said that we shall observe the program as scheduled. She went to her chamber and send water bottles for us.

Next, CGM entered in his chamber and immediately called us for discussion as he will be leaving for another meeting with the Chief Secretary West bengal at 11 AM. Sh Amit Gupta on behalf of the Association went to his chamber and informed that our discussion cannot be held in a hurried way. Let him complete the meeting with the Chief Secretary, we may hold our meeting afterwards. CGM expressed his sorrow and requested not to sit in the corridor, instead we may sit in some room. We said that we are comfortable in the corridor and wait for his return.

On his return the meeting took place at 3 PM. From our Side Coms D Biswas, S Sarkar, P M Chattaopadhayay, M Roy, S Mukherjee, A Gupta, T Mukherjee, P.Ghosh, P K Samanta, S Chatterjee, and from Management side, CGM, GM (HR), Sr GM(F), DGM(F), AGM(HR), AO(Cash) etc participated. At the outset CGM expressed his sorrow again for this developments which led us to stage this SIT IN STARVATION and said that he never knew that such frustration has developed in the mind of the pensioners, He requested the officers on management side to behave polite and gentle to the elders and to the ladies even if they speak irrelevant. He further said quoting in Sanskrit that whatever is due to anybody has to be paid in due time otherwise it loose its importance. He also mentioned that such inefficiency he has inherited due to legacy but he shall try to improve the situation.

In reply we pointed out that we are also not happy to stage such demonstration at this old age and sitting in the floor for so many hours in starvation, but the situation has compelled us to do so. The situation could have been avoided if management held the discussion one day early. We pointed out the stereo typed letter send to us by email yesterday signed by DGM(F). In the said letter it was claimed that " West Bengal Telecom Circle is well aware of its responsibility on both reimbursement of medical bill as well as work related to 78.2% IDA merger". <<<Click for letter>>> But the fact is that after issue of the 78.2% IDA order by BSNL, 3 months have elapsed but circle office could not send even 3 service books to CCA office. Also on medical issue bills are pending for nine months and now it is mentioned in the same letter that 60 more days are required. Under this situation how the management can put a tall claim that it is well aware of its responsibility. We mentioned that as per corporate office guidelines medical bills are to be paid within 30 days of claim but here it is being officially said that the period will be of one year.
On 78.2% issue we pointed out that unless the fixation is done by 31st October and the service books are send to the CCA office, we cannot get the payment by 31st December as notified by DOT since further works are involved in CCA office and in respective banks.. Further the practice introduced by WBTC to fill up a form mentioning personal details of the pensioners should immediately be stopped. Because it will never be possible to contact all pensioners particularly family pensioners and gr D pensioners who are now away to their native places in Bihar and UP and therefore their particulars cant be obtained from them and as a result their pension will remain unrevised. We demanded suitable time bound action so that we get the payment as scheduled.

In reply Sr GM(F) has fully appreciated our points and appealed us to give some time to rectify the work procedure of circle. She also while recalling her old experience with many of us expressed her sorrow for the harassments caused to us and assured that she will take care so that similar situation do not repeat again. Ultimately the following decisions are taken as per our suggestion and demand.

1) Hence forth the format of the claim form for medical bill will have two more items:

  • The HR No or Vendor Code : For those pensioners who had HR NO at the time of retirement shall mention the same and those who did not have will leave the item blank for the first bill. Circle Office will issue a Vendor Code from the pool and fill it up in the blank and simultaneously intimate the pensioner on his mobile. From next bill onwards the pensioner will have to mention the same in the claim form.
  • There won't be any TDS for the medical bills for pensioners hence fourth. For this at the end of the form a declaration will be there stating that the TDS may not be done and the required I Tax will be paid by the pensioner.
    The revised claim form will be issued by the circle shortly. We shall upload the same in our website in due course.

2) The present practice of filling up the format by the pensioners will be stopped by all SSAs. Necessary fixation work for 50% of Pre 2007 cases and 50% of post 2007 cases are to be completed by all SSAs by 31st October and sent to the CCA. Remaining 50% work to be completed by 15th Nov 2016 by all SSAs.

3) Sr GM (F) Mentioned that as per her knowledge no medical bills are pending before April 2016. If any such cases are there the Association may submit those directly to her. However all Pending bills from April to Sept 2016 will be paid by 15th Nov 2016 positively. We request all pensioners to submit the details of the pending bills submitted before April 2016 by SMS to 9433000088 mentioning Name, Designation, HR no, Office, Date, Amount etc immediately for further submission to Sr GM(F).

4) One Form for ERP to be submitted by all pensioners who did not have HR NO. The Form will be issued by AGM (HR) soon. We shall upload the same when received.

The meeting ended with a happy note and with CGM's comment that "we will meet again on 1st December to review the situation".

Necessary executive order mentioning the above points will be issued tommorow(19/10). We shall upload them as and when received.

Thus today's SIT IN STARVATION program is a great success. It will extend required benefit to all the pensioners. About 80 members of AIRBSNLEWA took part in the program. We salute them. As committed by AIRBSNLEWA to protect the pensioners right of pension and medical, this is another victory for all pensioners executive or non executive. <<<<click to view glimpses>>>>

03.10.2016:   CIRCLE CONFERENCE OF WEST BENGAL STATE BRANCH  
3rd Circle conference of West Bengal State held on 1-10-2016 at CTO auditorium Kolkata. From CHQ New Delhi Com GS & Com President has attended the conference. CHQ office bearers from Kolkata VP, AGS-1 & OS (E) also attended. It was also attended by 300+ members. 11 new life  members were enrolled and 58 life members have cleared their donation. The meeting started at 2.15 PM with president's address and observation of 2 mins silence in memory of departed pensioners. Circle Secretary Com Sitanshu Sarkar placed his report , which was unanimously accepted by the house. <<REPORT>>. 15.09.2016:  BSNL Corporate office issues Guidelines regarding recovery of excess/ wrongful payments made to employees of BSNL at the time of Retirement. 08.09.2016:   Meeting with GM (Admn.), BSNL Corporate Office:

Com Prahalad Rai along with the GS AIRBSNLEWA Com Kishan Singh met with GM (Admn.), BSNL Corporate Office.

A Outdoor medical bills reimbursement: We expressed our anxiety regarding delay in the preparation of the   web based application to monitor the progress of the payment of the medical bills. GM (A) informed that he has spoken to CGM ITPC today itself who has informed that the said application is ready and asked to depute some officer from BSNL CO. GM (A) mentioned that he is deputing one DGM level officer to ITPC in the next week. CGM ITPC has assured to commission the said web based application for the use of our pensioners within this month.

B Free calls as per BSNL order in concessional telephones: They mentioned that the free calls allowed in the concessional telephones are 500+50 calls which should be 500+220 calls to BSNL as per order of BSNL dated 20-07-2007.  We again reiterated that we are not asking to enhance the ceiling limit on concessional telephones to BSNL pensioners. We are demanding just to allow the free calls allowed to the General Subscribers over and above the calls allowed for the pensioners and again submitted a letter in this regard. <<<<Click here for copy of the letter >>>  GM (A) appreciated our concern and assured to look into.

C Allowing night calling facility in concessional telephones: They mentioned that the free Night Calling Facility as introduced in land line phones has not been extended so far to the concessional land line phones for pensioners. GM (A) informed that a proposal in this regard is in pipe line wherein competent authority has asked him to discuss the issue with Finance Wing. GM (A) assured for an early action in this regard.

GM (A) further mentioned that recently BSNL entered into an MoU with Apollo Pharmacy wherein Apollo Pharmacy unit of Apollo Hospital Enterprises Limited has offered (a) 12% discount on Pharma Products, (b) 5% discount on FMCG products (daily used items e.g. soaps, shampoos etc.) and (c) 15% on PL (Aplollo Pharmacy products). However, this offer would not be valid for (i) Apollo Pharmacies based in a Hospital premises and (ii) DPCO medicines.  <<<<Click here for copy of the letter >>>. Well organized historical General body meeting  of  “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” UP(East)  Circle  was held on 3rd September 2016 at “HOTEL  SAPNA  CLARKS  INN” Ring road  Lucknow  in presence of our General Secretary Com. Kishan Singh,  A huge gathering of BSNL pensioners  from Lucknow and different district of Utter Pradesh has attended the meeting which lasted for more than four hours. MEETING WITH CCA UP :
Today(7-9-16) morning at 11:00 hrs. Com Pallab Bose CS & Com C.S.Verma Finance Secretary met Shri Uday Bhan Tewari CCA Uttar Pradesh in his chamber and discussed the issue of 78.2% IDA merger from 1-1-2007 and consequent pension revision. We pointed out the provision of the order that the Job has to be completed by 31-12-2016. We requested him to issue a letter to CGM UP (East) for early sending of pension cases with the service books of their pensioners and fixation memos along with prescribed Performa with a time limit so that the time frame given by DOT materializes. Dy CCA Mr. Angad Singh was also present in this meeting. Circle Secretary Com Pallab Bose mention that , CCA WB has issued a letter along with required Performa to concerned officers, but unfortunately no such letter has been issued in our Circle till date.
Shri Uday Bhan Tewari CCA appreciates our concern regarding pension arrear of BSNL pensioners & assured to take necessary action within two days. He has immediately instructed to his Dy CCA Mr. Angad Singh to issue a letter along with prescribe Performa to all concern with necessary instruction.
The whole issue was discussed in detail with at length for about one hour in a very congenial atmosphere and assurance of CCA Uttar Pradesh was very positive.

07.09.2016:   Meeting with CGM UP(East) Circle Lucknow.:

Our UP (East) Circle had a meeting with Shri T.N.Shukla CGM UP East on 2nd Sept. 2016 in his chamber. The meeting was attended by the CGM, & GM (NWP-CFA).& from Association side Com Kishan Singh GS, Com A.K.Jain CHQ Finance Secretary, Com Pradip Goyel AGS, and Com S.M.Abbas Circle President, Com Pallab Bose Circle Secretary, Com C.S.Verma Circle Finance Secretary AIRBSNLEWA UP (E).  .

Com Kishan Singh GS AIRBSNLEWA apprised to CGM regarding the issues raised by our Association at CHQ Delhi level. He told that he is very much serious about the welfare and issues of our retired executives. He appreciated the role of our Chief mentor Com Prahalad Rai in our Association.

Further the discussion was held on the following issues:

 (1) 78.2% IDA merger for pensioners: - Circle Secretary Pallab Bose told the Hon’ble CGM that total 8000 BSNL pensioners retired between October 2000 to 9th June 2013 out of which 1800 are Executives. In UP (east) Circle is waiting for revision their pension after 78.2% IDA merger.Further he told that the present practice which is followed for revision of pension of BSNL pensioners in that BSNL offices have to issue individual pay fixation memos & pension sanction memos send it to the concerned CCA  offices along with the service books and only thereafter CCAs take action to notify the banks for payment order .  Such process requires considerable manpower and time, and pensioners had to wait indefinitely for completion of the process with anxiety and worry.  

Circle Secretary requested to CGM that without his interference, pensioners could not get their pension arrears well in time.  In this regard CGM appreciated our concern and assured for early action.However, CGM further assured to discuss the matter with CCA Utter Pradesh for an early action.

 (2) Payments of pensioner’s medical claims within one month time as per BSNL CO order: -  Regarding medical claims we told that although the overall situation is better now still in some areas the delay is prevailing specially in  some SSA’s.

(3) Stepping up case of Sh B.R.Singh retd DE Mau.:  We requested to instruct the concern officer to recheck the stepping up case of Shri B.R. Singh as per JTO training mark sheet, (because as per marks, Sh B.R.Singh is senior then Sh C.P.Singh) and issue the order accordingly.

(4) Maintenance of Land line & broad band connection: - CS told that retired executives of our Association are very much depressed as their service telephone connection as well as broad band connection are not properly maintaining in some area. We have intimated some Tel. no to the CGM which is faulty since last one year.

The Meeting lasted for one hour in a very congenial atmosphere and assurance of Hon’ble CGMT was very positive.         

05.09.2016:(13-00 hrs)    MEETING WITH CCA WEST BENGAL: Com Amit Gupta, Sadhan Chatterjee and Manas Roy met Shri Abhoy Singh CCA West Bengal today morning. Sh Joydeep Guha Jt CCA was also present. Two CAOs were also in the meeting. Our discussion was centered on the letter submitted on 31-08-2016. <<CLICK>> We highlighted the difficulties if ADHAR is linked with pension revision. CCA informed that they had already taken decision on last Friday and necessary order delinking ADHAR will be issued today. It was further clarified by him that for pre 2007 pensioners Service Book need not be sent by the SSAs, the same has to be sent for post 2007 pensioners. Single service book should not be sent, it has to be sent in batches of 10 service books or more. He also informed that 3 consultants are being appointed from pensioners by interview to complete the Pension Revision work within scheduled date.

Further the CCA discussed some issues of pensioners which are being planned by DOT/CCA Office.
1) Holding of Pensioners Meet in SSAs on Regular Basis : On 23rd Sept '16 One Pensioners Meeting will be arranged at Asansol. About 20 PPOs will be handed over to the pensioners retired recently. The problem and suggestion from  the pensioners/ pensioner Association also will be heard. Similarly another meeting will be arranged in Siliguri in November. The Ultimate plan of the CCA office is to hold monthly (First week of the month)  pensioner meets at Five SSAs which are Buisness Heads. In these meeting PPOs of the pensioners of nearby SSAs who retired in previous month will be handed over. Thus present delay caused by the banks will be avoided.
2) Functioning of CCA office as Pension Disbursement Office (PDO) : Along with the present method of pension disbursement through Banks and Post Offices, CCA office will disburse the pension directly to the account of the pensioners. This system will be optional and pensioner can choose this method if he desires. We pointed out that the system is good but there may be difficulty in submission of life certificate which presently done in banks or Post Offices near to pensioners address. CCA appreciated the point and assured to find out a solution of this difficulty in the proposed system.
The Meeting lasted for 45 Mins. in a very congenial atmosphere.
31.08.2016:   DOT issues order mentioning the rate of contribution to be paid and entitlement of wards by BSNL/MTNL pensioners who are willing to have medical facilities under CGHS . This is an achievement of AIRBSNLEWA who were in constant negotiation with DOT & BSNL since last 2 years. Click for the Order

Now as usual the credit is claimed by the "Armchair Association", who claims that this has been issued as a result of their letter to Dir (HR) BSNL only on 4-8-2016. This is an old game being played by them. "Watch the developments of the issues taken up by others sitting in the armchair. When the issue is about to be matured write a letter creating the ground and then claim the credit when the issue matures". In the same way this association has created ground for the issues of Free Night Calling Facility to Concessional Telephone and Medical Bill Tracking Module for pensioners as the issues are near settlement after continuous negotiation by AIRBSNLEWA since last 10 months.  

31.08.2016:   Meeting with Different officers: Com Amit Gupta & Com Sadhan Chatterjee met various officers on pensioners issue on 31-08-2016:
1) Sr GM(Fin) West Bengal Circle : They met Smt Rupa Pal Choudhuri Sr GM(F) and discussed the problem developed due to the letter of CCA WB making ADHAR as mandatory item for pension revision work. Copy of our letter to CCA was given to her for necessary action. She appreciated the problem and assured to discuss with CCA WB. She also requested us to inform the outcome of our meeting with CCA WB next week.  
2) CGM West Bengal Telecom Circle: They met CGM WBTC Sri R N Jha and appraised him also the problem developed. CGM was of the opinion that since linking of ADHAR is a policy of present central Govt. there is nothing wrong to link it with pension revision work. ADHAR No and PAN no has to be entered in the service book. They informed him about the KYP drive undertaken by Pr. CCA last year and almost information of 9000 pensioners are already available with Pr CCA which can easily be shared by CCA WB instead of repeating the whole process by the SSA heads of WBTC. CGM appreciated our view and assured to initiate necessary action in consultation with his management.
3) CCA Calcutta Telephones: They met Sri Dekhu Turwar CCA Kolkata in the afternoon and discussed the issue of 78.2% IDA merger from 1-1-2007and consequent pension revision. They pointed out the provision of the order that the Job has to be completed by 31-12-2016. They requested him to issue a letter to Calcutta Telephones for early sending of the service books and fixation memos with a time limit so that the time frame given by DOT materializes. The whole issue was discussed at length for about 30 minutes and it was explained to him that this issue is a different one than the implementation of 7th CPC order. Sri Turwar assured to take necessary action within next Monday.

4) They also met DGM (S&M) CTD, DE (HCU) CTD regarding empanelment of CGHS approved Hospitals on cash basis at CGHS rates and on disposing the cases registered in CPGRAMS with vague remarks. Both has assured for early action on respective issues.

24.08.2016:   Meeting with Member (Services), Department of Telecommunication, New Delhi

Com Prahlad Rai along with GS of AIRBSNLEWA met with Member (Services), Department of Telecommunication, New Delhi and apprised him  about the present practice which is followed for revision of pension of BSNL pensioners is that BSNL offices have to issue individual sanction memos and send it to the concerned CCA offices along with the service books and only thereafter CCA s take action to notify the banks for payment order. Each time when there is a pension revision, BSNL has to undertake this workload although it has got no relation with the process of pension revision. In 2011 BSNL thus issued revised pension memo for about 1 lakh pensioners and this time again it has to repeat the process for 78.2% IDA merger from 1-1-2007 for same no of pensioners retired before 1-1-2007. After implementation of ongoing 3rd PRC recommendation, BSNL has to issue similar sanction memos for about 2 lakh pensioners retired till 1-1-2017.

 

They mentioned that the such process requires considerable manpower and time. And the pensioners had to wait indefinitely for completion of the process with anxiety and worry. This process can be made simplified and the role of BSNL in this process may completely be eliminated as BSNL has got no responsibility now regarding payment and revision of pension.

 

While implementing the VII CPC recommendations, the DOP&PW has ordered vide Para 9 of its OM No. 38/37/2016-P&PW(A)(ii) dated 04.08.2016 for adoption of the  procedure for revision of pension of the existing pensioners/family Pensioners by authorizing the disbursing authorities including the public sector banks to disburse revised pension without waiting for further authorization from Accounts Officers/ CCAs  concerned. Similar procedure was followed while implementing VIth CPC recommendations by Govt. of India in the year 2006.

 

They requested Member (S) to follow the same principle for the BSNL pensioners also for the pension revision, which  has been laid down by DOP&PW for Central Govt. Pensioners. This will reduce the volume of work in BSNL Offices for the pensioners already retired before the date of effect of such pension revision. However where the question of pension revision requires pay revision also as the case of implementation of 78.2% IDA for the present pensioners retired between 1/1/2007 1and 9/6/2013, BSNL offices will have  to prepare the revised pension papers/ calculation sheets.

17.08.2016:   Yesterday Our CS West Bengal Com Sitanshu Sarkar, ACS Com K C Samaddar and com S N Das visited CGM ETP office for early implementation of 78.2% IDA merger issue of Pensioners. They met GM (HQ) and DGM (Fin). both has assured early action. They also met DGM (Alipore) CTD, who is located in the same office  and requested to complete the 78.2% related job quickly.

02.08.2016:  Meeting with GM (A), BSNL Corporate Office, New Delhi:

Com Prahlad Rai and GS, President AIRBSNLEWA met GM (A) BSNL Corporate Office, New Delhi and discussed regarding:

1 Corporate office should send instructions to CGMs to empanel CGHS approved hospitals and make agreement with them so that they-
a) Offer treatment to BSNL pensioners at CGHS rate on cash payment basis.
b) At the time of discharge they certify on the bills that the treatment is made as per CGHS prescribed rates and also supply the necessary documents required for reimbursement like ‘bed head ticket’ etc.
c) On submission of the bills the reimbursement be strictly made within one month. A system should be there in ERP to monitor the pendency of the cases. This system should be introduced over and above the cashless system which gets defunct after sometime for non-payment of Hospital Bills.

On the above issues GM(Admn.) assured to issue instructions to CGMs from Corporate Office within this week time.

2. Corporate office should specifically issue fresh instructions to all concerned including zonal ITPCs for following provisions of the order of 2007 on free calls to concessional Telephones. We have approached the GMs of ITPC but they want clarification from Corporate Office.

In this regard GM(Admn.) appreciated our concern and assured to send a letter to CGM ITPC with respect to their discussions to issue clarification from Corporate Office shortly.

3. For preparation of the package for tracking outdoor medical bills, only 5% of the work done in ITPC Pune in last 3 months. Unless a strict instruction is issued they may take more time. The job should be completed by August 2016. Before implementation, a demo may be given to us for any modification for more usefulness of the pensioners.

GM(Admn.) inform that he has already discussed the matter with CGM ITPC Pune and the work for preparation of the package for tracking outdoor medical bills is in progress and CGM ITPC has assured to complete the package within 2-3 months time. However, GM(Admn) further assured to discuss the matter with CGM ITPC for an early action.

31.07.2016:  West Bengal Circle of AIRBSNLEWA has prepared the list of the pensioners (both Executive and Non Executive), who retired between 1-1-2007 to 9-06-2013, and submitted to administration for immediate initiation of pay fixation work by the Areas. As a responsible organisation AIRBSNLEWA always worked  for the entire community of BSNL pensioners, now also they prepared the list of both Executives and Non Executives. the lists are placed at the top of the website. Pensioners may verify their names and other details, This circle is also trying to prepare similar lists for other CGMs of West Bengal.  If any other circle has taken similar initiative, they may intimate for uploading in the website.
31.07.2016:   FAIZABAD District Branch of AIRBSNLEWA Formed
A well organized General Body meeting of “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” Faizabad District UP(East) Circle was held on 28-07-2016 at "HOTEL PANCHAVATI" near Deokali bypass, Faizabad under the chairmanship of Shri R.S.Rawat (Retd. DGM) in the presence of Shri Pallab Bose Circle secretary & Shri C.S.Verma Finance Secretary AIRBSNLEWA UP(East) Circle.. Number of pensioners attended the meeting which lasted for more than two hours.
Shri S.S.Shukla Retd.DE.Faizabad welcome the hon'ble members including CS, Finance Secretary & addressed the house.
After that guest and senior pensioners were felicitated by the Faizabad dist. body
meeting was addressed by Circle secretary, Finance treasurer, AIRBSNLEWA, Sh S.S.shukla DS , Sh R.S.Rawat retd. DGM, Sh P.N.Verma retd. DE Sh R.P.Singh Dist. President and many other retd. BSNL executives. Com Pallab Bose Circle Secretary apprised members of Faizabad in detail about the approval of long pending Cabinet notes on 5th July 2016 by Govt. of India. He has congratulated the CHQ for these remarkable achievements of 78.2% IDA merger and abolition of 60:40 pensions sharing with BSNL. He told that 60:40 pensions sharing with BSNL is more important than 78.2% IDA merger benefit. Through written communication, frequent personal meetings with the senior officers and series of RTI applications which unveils the hidden facts forced DOT to move proposal for annulment of this anti BSNL pensioner’s clause.
Com Bose also apprised the members that our Association AIRBSNLEWA had initially raised 60:40 pensions sharing issue since long time. He mentioned that today many association' is claiming the credit of achieving the demands but in reality they did nothing about it. If their websites are surfed for old news, it will be very well seen that they never spent a single word on 60:40 issue.He assured the members that AIRBSNLEWA will take appropriate action at the correct moment. He also clarified other issues like 3rd PRC, Medical issues discussed with Director (HR) BSNL etc and explained the actions being taken by our General Secretary AIRBSNLEWA. There was a nice interactive session and Circle Secretary Com Bose answered every question raised by members & cleared many doubts.
A useful Journal “AIRBSNLEWA VOICE” distributed to all new members of Faizabad branch presence in the house .
Circle Secretary narrate in detail the gains and losses of Pre-2007 pensioners, Post- 2007 pensioners, and handsome amounts due but not being paid by DOT.
Finance Secretary Com C.S.Verma in his address described in details regarding fixation of pay on promotion in respect of BSNL executives under 2nd PRC w.e.f. 01-01-2007. Further he told that the amount pensioners are not getting is much more than what they are getting. He also clarified other issues like Medical payment, arrear payment of 78.2 % IDA.

29.07.2016:   Meeting with Director (DPE):

Com Prahlad Rai along with Com M K Bagchi Convener / United Forum (MTNL), GS, TEA MTNL, GS MTNL Staff Union and GS AIRBSNLEWA met with Shri S. Meekshisundram, Director, DPE and submitted a letter regarding revision of Pension of BSNL/MTNL Pensioners to make the terms and reference of 3rd PRC. Director (DPE) assured to put up the matter to the concerned authorities. He adviced to meet the Member Secretary of 3rd PRC Shri Madhukar Gupta, Addl. Secretary, DPE to apprise him the case. They tried to meet Addl. Secretary, DPE also but he not was available, hence, shortly they will meet all the concerned officers of 3rd PRC to discuss the matter of revision of pension of BSNL/MTNL Pensioners and also to discuss the questionnaire submitted by AIBSNLEA.

29.07.2016:   Meeting with Secretary (T):

Com Prahalad Rai along with Com M K Bagchi Convener / United Forum (MTNL), GS, TEA MTNL, GS MTNL Staff Union and GS AIRBSNLEWA met with Secretary (Telecom), DoT and submitted a joint representation for taking initiative to include the issue of pension revision of BSNL/MTNL pensioners immediately in the terms and reference of 3rd PRC as the pension in BSNL/MTNL is the Govt. Pension payable by DoT under the statutory provisions of Rule 37-A of Central Civil Services (Pension Rules), 1972. Secretary (T) appreciated our concern and told that this matter has to be addressed by 3rd PRC, however, he assured to look into.

28.07.2016:   Meeting with GM (A), BSNL Corporate Office:

Com Prahalad Rai along with the GS, President and FS of AIRBSNLEWA met with GM (A), BSNL Corporate Office. Earlier this meeting was scheduled to be held with Director (HR), BSNL Board as a follow up of the meeting held with her on 25.07.2016 regarding the pending issues of BSNL Pensioners. Director (HR) due to her business in the Management Committee directed GM (A) to discuss the issues. Accordingly following issues have been discussed:

A Outdoor medical bills reimbursement: They mentioned that the pensioners are kept out of scope the ERP. Their claims are still manually processed and entered in the system only at the last stage before payment. It is true that the payment is now deposited to their bank accounts but they are not informed the payments vis a vis the pending bills. They are also not informed about the receipt of the bill or the progress of the bill. We requested to bring the pensioner also in the scope of ERP. GM (A) appraised that he has spoken to CGM (ITPC) in this regard who has informed that a web based application like ERP is being developed at ITPC through which the pensioners will be informed regarding the progress of the payment of their medical bills. The application would be ready within next two-three months.

B Indoor medical treatment:  They mentioned that other than Delhi, almost in all circles the number of empaneled hospitals for treatment on cashless basis is bare minimum. In some circles for month together no empaneled hospitals are there. TPA system as is available in other corporate or linking with LIC as done by CGHS may be introduced. The committee constituted for reviewing the BSNLMRS should hear the voice of pensioners also as their need is different than the serving employees to some extent. GM (A) appreciated our concern and mentioned that he has already instructed field units to empanel as many as hospital who are ready to give medical facilities at the rates decided by CGHS for treatment of BSNL employees/pensioners. Regarding Delhi NCR region, he categorically mentioned that if any hospital is ready to give medical facilities at the rates decided by CGHS then it should be impressed upon to give a formal Expression of Interest (EOI) to him so that he can process this case for its empanelment in BSNL.   

C Free calls as per BSNL order in concessional telephones: We mentioned that the free calls allowed in the concessional telephones are 500+50 calls which should be 500+220 calls to BSNL as per order of BSNL dated 20-07-2007. GM (A) mentioned that there are clear direction on the Circular dated 20.07.2007 that the free call limit on concessional telephones is over and above the limit available in general. They pointed out that the order is not being implemented by the field units including ITPC. GM agreed to issue necessary instructions.

D Allowing night calling facility in concessional telephones: We mentioned that the free Night Calling Facility as introduced in land line phones has not been extended so far to the concessional land line phones for pensioners. GM (A) informed that a proposal in this regard is already in pipe line as soon will be finalized and the orders will be issued.

27.07.2016:   2ND CIRCLE CONFERENCE OF DELHI CIRCLE : A huge gathering of BSNL pensioners stationed at New Delhi has attended the CONFERENCE of Delhi Circle of AIRBSNLEWA at CTO Auditorium, Eastern Court, New Delhi.Com Prahlad Rai Chief Mentor was the special guest. All present developments related to pensioners have been explained in detail by Com Kishan Singh GS. Com Rakesh Srivastava President in his address informed the house that this is the only Pensioners Associations who is genuinely fighting for all the issues of pensioners irrespective of executive or non executive. He explained in details the policy of this Association and future plan of action. Com Rai In his address appraised in detail the efforts in the formation of AIRBSNLEWA to protect the interest of BSNL pensioners and for the settlement of their medical, pension and other personal claims etc. In true sense AIRBSNLEWA is safeguarding the interest of BSNL pensioners by settling their day to day problems of medical claims, Telephone bills/ BB facility and issues related to pension revision etc. Recently DOT issued 78.2% IDA pay fixation order for BSNL pensioners after continues struggle of AIBSNLEA and AIRBSNLEWA. The 60:40 sharing provision from pension Rule has also withdrawn after great efforts. It has strengthen the way for future pension revision of BSNL Pensioners. It is a great achievement of AIBSNLEA & AIRBSNLEWA.
Director (HR) is holding meeting with AIBSNLEA and AIRBSNLEWA representatives tomorrow at 15.30 hrs. to discuss the issues related to BSNL pensioners Telephone/BB facilities, payment of medical bills through ERP etc. In this manner AIBSNLEA & AIRBSNLEWA are making sincere efforts for the settlement of the grievances of BSNL pensioners.
In many circles the AIRBSNLEWA circle body have been formed but still some circles the circle bodies are to be formed. He assured full co- operation in this regard. He also informed that CGHS Medical facility orders from DOT to BSNL/MTNL pensioners are expected shortly. He further assured fullest support to AIRBSNLEWA. The conference hall was jam packed. 26.07.2016:   As reported by us yesterday, BSNL today endorsed the 78.2% order issued by DOT. All Circle Secretaries / Branch Secretaries may initiate action with their counterparts in BSNL/CCAs for early implementation of the order, View the endorsement  
25.07.2016:   Com Prahlad and Com Kishan Singh GS AIRBSNLEWA met Director (HR) and discussed regarding:
a.) Issues related to BSNL Pensioners i.e free night calling, increase in B/B uses, Payment of Medical bills through ERP etc.: They requested for early settlement of all these issues. Director (HR) decided to hold a separate meeting to discuss all these issues on 28/7/2016 at 15.00 hrs. with AIBSNLEA and AIRBSNLEWA.
b) Endorsement of 78.2% IDA Pay fixation case of BSNL Pensioners: They requested Dir (HR) for the endorsement of DOT order on 78.2 IDA Pay fixation of BSNL pensioners. Director (HR) spoke with GM(Estt) and directed to endorse the DOT order immediately. Dir (HR) assured that by tomorrow the order will be endorsed.
c) Pay fixation and settlement of Pension of BSNL employees: They requested for the early settlement of the pension cases of BSNL pensioners in CCAs. Director (HR) assured to look in to the matter.
25.07.2016:   CIRCLE BODY OF GUJRAT AIRBSNLEWA FORMED : A meeting was organised at Western Rly. Mazdur Sangh Hall, Ahmedabad on 24/07/2016 where the pensioners of Ahmedabad participated. Com R S Parihar presided over the meeting. The present scenario of the BSNL pensioners was discussed at length. 22.07.2016:   Removal of 60:40 Clause towards the payment of pensionary benefits to the retires employees: DOT ultimately modified the liability of BSNL towards the payment of pensionary benefits to the retired employees vide letter number 40-13/2013-Pen(T) dated 20.07.2016 <<<Click here for letter>>>.
Now-

a. The pension liability in respect of employees of DOT/DTS/DTO who retired prior to 01.10.2000 is solely borne by Government of India and the BSNL will have no liability in respect of these employees.

b. The liability towards pensionary benefits including family pension to the BSNL employees (excepting those recruited after 01.10.2000), as per sub-rule 22 of Rule 37-A of CCS (Pension) Rules, 1972 lies with the Government of India. The condition that the annual pension liability of the government shall not exceed 60% of the annual receipts to Government from the item specified in the O.M. dated 15.06.2006, is hereby rescinded.

c. BSNL will continue to discharge pension liability by way of pension contribution in accordance with FR 116.

This is an another feather in the cap of AIBSNLEA and AIRBSNLEWA,  who fought and persuaded from bottom to top to get a rid from this arbitrarily imposed provision on BSNL and thus ensures bright future of DOT/DTS/DTO employees aborbed in BSNL.

21.07.2016:        General Body meeting of UP (East) Circle

Marvelous  and well organized General body meeting  of  “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” UP(East)  Circle  was held on 18th July 2016 at “Jai Shankar Prasad Hall” Kaiserbagh  Lucknow  in presence of our CHQ President Com. Rakesh Srivastava. Hundreds of pensioners attended the meeting which lasted for more than three hours.

After observance of two minutes silence in memory of departed members the meeting started with the opening remark of Circle President Com S.M.Abbas. After that newly elected CHQ Office Bearers Com Rakesh Srivastava CHQ President and Com D.N.Verma CHQ Organizing Secretary were felicitated by the circle body.  Com Pradeep goyel AGS could not be felicitated as he could not attend the meeting due to his personal problem. Com Rakesh Srivastava CHQ President was especially welcome by Circle Secretary, Circle President and Com C.S.Verma Finance Secretary.

He told that only our Association AIRBSNLEWA had initially raised 60:40 pensions sharing issue since long time. He mentioned that today many association' is claiming the credit of achieving the demands but in reality they did nothing about it. If their websites are surfed for old news, it will be very well seen that they never spent a single word on 60:40 issue.

CHQ President Com Rakesh srivastava in his address described in details the development of 60:40 issue, how it was mischievously kept secret from all and how it was unveiled through RTI. He mentioned that AIRBSNLEWA was always informed that the 78.2% IDA merger and 60:40 issues are interlinked and cannot be settled in isolation. The same thing happened now. Even the method of 78.2% IDA merger as was informed by us even two  years back has taken place today in exactly in same manner He specially  congratulated Sh Amit Gupta for his foresightedness and brining into light the draconian 60:40 cabinet decision through series of RTIs.

The amount pensioners are not getting is much more than what they are getting. He assured the members that AIRBSNLEWA CHQ will take appropriate action at the correct moment. With the efforts of Com S.S.Shukla Retd DE and Com V.S.Seth Retd. DE of Faizabad, 13 new pensioners of Faizabad district took enrollment as Life Members and adhoc body of Faizabad district have been formed.

20.07.2016:  Withdrawal of 60:40 Pension sharing provision of BSNL Pensioners:
Com Prahlad Rai Chief Mentor met DOT Officers regarding withdrawal of 60:40 pension sharing provision of BSNL Pensioners.  It is informed that a separate order w.r.to 60:40 provision withdrawal is under process to Secy. (T) for approval and the necessary order in this regard is expected shortly. (Most probably by tomorrow 21/7).

Ever since the Cabinet has decided to annul the 60:40 clause, the  Minister Dependent Association in their website started claiming that only due to them the draconian clause has been annulled. In support of their claim they published a long list of their activities. Recently they arranged a special celebration at Bangalore where a ex GS of an executive association who has retired with all benefits of 78.2% IDA, but never written a line protesting 60:40 while he was GS, declared that “ But for the efforts of AIBSNLPWA these cases could have been delayed further by years ; notwithstanding the claims of others. He specially lauded the significant achievement of annulment of 60:40 condition after 12 years”. Being curious to know the reality we surfed the entire website of this Association including the archives. Following is the result :

  • In the archive (news section) total 23 pages are available. The oldest news available is from 18-04-2015. Page 1 is the current page. There is no mention of the word 60:40 in all the pages from 2 to 23 except in page 19 , dated 24-7-15 ,where it is mentioned while reporting 78.2% case “ It seems the delay is due to divergent views on removal of 60:40 condition on sharing of pension liability”. The next time the word 60:40 appeared in their website is on 5-7-2016 after the cabinet decision and since then their had been many mentions claiming the credit.
  • In between they had their All India Conference at Bangalore in Nov 2015. We searched the proceedings uploaded in the website. There is no mention of 60:40 anywhere. Pensioners may go through aic_bg_brief  and keynote address presented in the open session. Even in the open Invitation to the pensioners they mention the two important issues as 1) 78.2% IDA merger 2) Pension revision of IDA pensioners. No mention of 60:40 anywhere during their AIC.
  • During the period of last one year this Association met ministers, DoT officers etc several times and submitted memorandum. Here again no mention of 60:40 anywhere.

    While placing the above information as collected from their website, we gracefully acknowledge their efforts for the case of 78.2% IDA merger, evidence of which is available in every page of their news archive, but for 60:40 this association had no role whatsoever.

    NB: As reported in the website, the GS of this Association met Secretary DOT and other senior officers of DOT yesterday. They also published the points they discussed. There is no protest against the deprivation caused to the 1.50 lakh pensioners denying their arrears of pension and pensionary benefits from 1-1-2007 to 9-6-2013. Also they forgot to mention that in the order issued by DOT there is no mention of the Cabinet decision on 60:40. They did not discuss the important issue of pension revision of IDA pensioners also.

 18.07.2016:                   78.2% ORDER ISSUED BY DOT             CLICK

The 78.2% IDA merger order did not mention anything about annulment of 60:40 and related cabinet decision. Whereas in the earlier pension revision order issued on 15-3-2011 the restrictions of 60:40 was mentioned. Govt may say as because now there is no restrictions on funding, hence nothing is indicated in the order. But the cabinet decisions which are general in nature should be followed by an executive order for the knowledge of all concerned. The necessary paragraph mentioned below of the Cabinet Decision as circulated by PIB should have been included in the order as was done in case of the pension revision order dated 15-3-2011.

"The pension liability in respect of employees of Department of Telecommunications (DOT) / Department of Telecom Services (DTS) / Department of Telecom Operations (DTO) who retired prior to 01.10.2000 is solely borne by Government of India and the BSNL will have no liability in respect of these employees. In respect of employees who are absorbed in BSNL, the liability on account of pensionary benefits shall be fully borne by Government while BSNL will continue to discharge pension liability by way of pension contribution in accordance with FR-116 for the period they so work/worked"

 AIRBSNLEWA shall be taking up the issue with DOT soon. Pensioners may note that the Associations claiming the credit of 60:40 annulment has not mentioned anything about this in their websites while reporting the issue of order by DOT till now. They are busy in celebration.

When we talk about the celebration, let us analyse  the order issued by DOT .
The pension of the pensioners retired between 1-1-07 & 9-6-13 will be revised from date of retirement by merging 78.2% IDA but will be paid from 10-6-13.
Thus they are being deprived of the 1) Pension Arrears from date of retirement to 9-6-13. 2) Additional Gratuity 3) Additional leave encashment 4) Additional pension commutation plus 5) Pay arrears from 1-1-07 to date of retirement like the serving employees pay arrears from 1-1-07 to 9-6-13. The employees retired after 10-6-13 is getting his all pensionary benefits on the pay/pension after merging 78.2% IDA but pensioners retired before 10-6-13 are being denied the above pensionary benefits.
Calculation shows that a person retired as SDE in July 2007 will get 78000 plus as arrears but will be denied of 2.25 lakh plus arrears on above four accounts.

For pensioners retired before 2007, they will be denied pension arrears from 1-1-07 to 9-6-13 which is also calculated to the tune of 1 to 1.5 lakhs depending on date of retirement.

These all denials are due to the fact that serving employees did not get pay arrears for 78.2% IDA merging from 1-1-07 to 9-6-13 which was to be paid by BSNL but could not be paid due to bad financial position of BSNL. Why pensioners whose dues are to paid by DOT should suffer for that ? Serving employees did not get pay arrears, similarly don't pay the pay arrears to the pensioners retired after 1-1-07, which is to be paid by BSNL,  but why their pension and pensionary benefits are being snatched ?
The no of such pensioners are about 1.60 lakhs and now they can get justice only through legal battle which will not be possible to 95% of these pensioners and family pensioners.
The serving employees Association and Unions can only bring justice to these pensioners if they want so. But till now none of them are vocal on this deprivation.
Everyone is talking of big achievement and claiming credit but are silent about the injustice done to the pensioners/family pensioners who's days are numbered.

The Minister dependent Association are still busy in their never ending celebrations and yet to realise that there is nothing much to cheer about in the order issued.
The Armchair Association , who are all along projecting wrong picture to the pensioners now realise the deprivation and tried to be vocal. But their actions are limited in writing some articles blaming others.

AIRBSNLEWA now shall concentrate in implementation of the order issued and at the appropriate time shall take suitable action which will bring justice to all pensioners.
 

15.07.2016:   78.2 % ORDER MAY BE ISSUED TODAY: After clearance of Member (F) DOT the file has reached back to Member (S) yesterday evening. Today the file will reach Director (Establishment) and therefore it is expected that the order may be issued by today evening. 
14.07.2016:    ORDER IS YET TO BE ISSUED: Com Rakesh Srivastava President enquired today morning. The file containing the draft order on 78.2% IDA merger and annulment of 60:40 is now pending with Director (Accounts), therefore one or two more days may be required to get the draft order approved.
14.07.2016:    LET SOME SANITY PREVAIL OVER THE CREDIT FOR RESOLVING 50%  IDA Merger Issue and withdrawal of 60:40 condition through Cabinet Decision
 
Game of ONE UP MANSHIP has gone too far and lot of mudslinging between some  pensioner organizations in BSNL  have take place over a period of last one week or so, which needs to end soon, sooner the better..
All the Unions/Associations have made their contribution in  their own ways in resolvig78.2% IDA issue and withdrawal of 60:40 condition through Cabinet Decision. We, on our part have uncovered the mystery of Cabinet Decision dated 27/1/2005, which was all along kept secret by Govt. of India and many others involved with the issue for more than nine years,. We, on our part,  analyzed the issue threadbare through perusal of responses received  from DoT under various  RTIs, published them for everyone's consumption and prepared write ups to educate our members and logically and forcefully presented our case to the Government of India highlighting the injustice and coordinated with various Ministries to expedite the settlement of this  issue.
Combined efforts of all the Associations/ Unions have yielded the desired result. Some Unions/ Associations may deserve somewhat greater credit as compared to others but it can neither be defined or proved in concrete terms with hard evidence. So it may be more prudent to observe discretion in our comments and not go for free for all.
Let us galvanize our forces for future regarding  assured Pension Revision in BSNL in future and also proper   implementation of proposed Parity of Pay and  scales between Executive and Non-Executives of  BSNL and MTNL w.e.f. 1/1/2017 as promised through the Cabinet Decision.

14.07.2016:   As scheduled a mammoth GB meeting of WB Circle of AIRBSNLEWA was held yesterday at CTO Auditorium Kolkata. More than 400 pensioners attended the meeting which lasted for more than 3 hours. 29 new members enrolled as life member. Newly elected CHQ Office Bearers Shri Swapan Mukherjee OS (East) and Shri Amit Kumar Gupta AGS, Sh Prasun Mukhopadhayay CS AIBSNLEA were felicitated by the circle body. Com Sitansu Sarkar in his address has congratulated the CHQ for this remarkable achievements of 78.2% IDA merger and abolition of 60:40 pension sharing system. He particularly congratulated Sh Amit Gupta for his foresightedness and brining into light the draconian 60:40 cabinet decision through series of RTIs. He mentioned that today many including the 'armchair association' is claiming the credit of achieving the demands but in reality they did nothing about it. If their websites are surfed for old news, it will be very well seen that they never spent a single word on 60:40 issue. He expressed his extreme happiness for the settlement which he described as the best reward of his life.
Com Amit Gupta in his address described in details the development of 60:40 issue, how it was mischievously kept secret from all and how it was unveiled through RTI. He mentioned that AIRBSNLEWA was always informed that the 78.2% IDA merger and 60:450 issues are interlinked and cannot be settled in isolation. The same thing happened now. Even the method of 78.2% IDA merger as was informed by us even 2 years back has taken place today in exactly in same manner. The '
armchair association' and 'the minister dependent association' had been giving various misleading information causing harassment to the pensioners during the period and now claiming credit in such a manner that the success has come only due to them and all other are useless. This attitude is called One Up Manship.
Sri Gupta further elaborated the loss being caused to the pensioners due to non payment of pension and pensionary benefit arrears up to 9-6-2013. The amount pensioners are not getting is much more than what they are getting. He explained the situation by citing two sample cases one of Pre 2007 and other of Post 2007 and assured the members that AIRBSNLEWA CHQ will take appropriate action at the correct moment. Now let us concentrate for implementation of the order under issue by DOT. He also clarified other issues like 3rd PRC, Medical etc and explained the actions being taken by AIRBSNLEWA. 12.07.2016:  Com Prahlad Rai Chief mentor, Com Kishan Singh GS AIRBSNLEWA met the DOT  Officers ie. Member (Services), Member (Finance), DDG(Estt), DDG (FEB), Director (Estt) and Director (PSU) and extended  sincere gratitude and thanks to them with "Sweets" for getting cleared the proposal of 78.2% IDA Pay fixation to BSNL Pensioners and withdrawal of 60:40 provision of Pension Rule-37 A from Cabinet, Govt. of India.  They also got cleared the file from DDG (FEB) Sh. Rajeev Kumar for issuing the order in this regard. Director (Estt) assured to issue order by tomorrow (13-07-2014) on this issue.

DDG (Estt) and DDG (FEB) mentioned that even on 4-7-2016 during Cabinet Meeting a certificate from DOT was asked to submit assuring that on implementation of 78.2% IDA Pay fixation to BSNL Pensioners and withdrawal of 60:40 pension will not cause  any previous financial liability on Govt. And the certificate was immediately given by DDG (FEB) to cabinet secretariat in this regard then the cabinet approved the above proposal.  Necessary orders in this regard are expected tomorrow (13-7-16).

11.07.2016:  The necessary orders on implementation of 78.2% IDA merger from 2007 for pensioners is under issue at DOT. The related file has gone to Member (F) from Member (S) DOT today.

West Bengal Circle is holding its GB meeting on 13-7-2016 at CTO Hall Kolkata at 2 PM sharp

UP(East) Circle is holding their GB meeting on 18-7-2016 at Jaishanker Prasad Hall, Rai Uma nath wali Auditorium near Baeadaei, Kaiserbagh Lucknow.

Both the circle has requested all the pensioners including their members to attend and discuss the issues of 78.2% IDA merger and abolition of 60:40 pension sharing system.

07.07.2016:                CABINET DECISION ON 5-7-2016

MOST REMARKABLE PART OF THE RECENT CABINET DECISION IS THAT HENCE FORTH COMPLETE LIABILITY FOR PAYMENT OF PENSION FOR ALL THE DOT PENSIONERS  RETIRING BEFORE 1/10/2000, AND  ALL THE  EX-DOT EMPLOYEES ABSORBED IN BSNL W.E.F. 1/10/2000 AND RETIRING AS BSNL PENSIONERS RESTS WITH  THE GOVERNMENT OF INDIA.
BSNL’S LIABILITY TOWARDS PAYMENT OF PENSIONARY BENEFITS IS NOW LIMITED TO ONLY PAYMENT OF PENSION CONTRIBUTION AS PER FR116 FOR ALL DOT EMPLOYEES  / EX-DOT EMPLOYEES ABSORBED IN BSNL OR  WORKING ON DEEMED DEPUTATION IN BSNL TILL THEIR RETIREMENT. AFTER RETIREMENT ALL RESPONSIBILITIES OF PENSION AND PENSIONARY BENEFITS ARE SOLE RESPONSIBILITY OF GOVERNMENT OF INDIA EXCEPT LEAVE ENCASHMENT WHICH WILL CONTINUED TO BE PAID BY BSNL.

This nullifies the earlier provision of pension payment dependency on BSNL’s payment to DOT. Only AIRBSNLEWA unveiled this draconian decision approved earlier by the Cabinet in January  2005 which was kept secret from the employees of BSNL. Since then we have been fighting against this along with AIBSNLEA. Many laughed at us but they  never wrote a single  letter against such decision but today these very persons  are more vocal than anybody  else claiming the decision of annulment of 60:40 condition as their ‘Big Victory’ in their websites. Some are claiming that they  were fighting this issue since 2009, but can they furnish any document in support of their claim. Fact remains that almost all were silent over the 60:40 issue all the years and now making tall claims. If you scroll through their websites you will understand the truth. Anyway let them rejoice and  be happy.

The decision of annulment of 60:40 provision defining / reducing pension liability of Govt. f India  is really a bigger achievement than 78.2% IDA merger. It will permanently eliminate any financial hurdle for all future pensionary  payments and revisions  to all present and future BSNL pensioners. This great achievement needs to be attributed to efficient and active persuasion of our CHQ along with AIBSNLEA and our Chief Mentor Com Prahlad Ji and the tactical pressure generated on DOT by uncovering the hidden story of 60:40 RULE through series of applications under RTIs by Com Amit Kumar Gupta our AGS AND HIGHLIGHTING THE SAME THROUGH OUR WEBSITE. Official communications condemning such decision has been continuously made by us and AIBSNLEA apart from various personal interactions with DOT officers from time to time during last 3 years.

The outcome of this Cabinet Decision has been informed to our members long back through this website. If you scroll back our old news, you will find that we have correctly intimated you all the happenings. We never deviated from one point to other like other Associations. From day one we said that there will be NOTIONAL fixation on both pay and pension before 10-6-2013 and other pensionery benefits will not be paid. We also said that unless 60:40 is not settled, pension revision is not possible as question of funding is coming in the way. Today the same points are approved by the cabinet. Anybody can verify these from our website’s series of old postings since last 2/3 years.

Since the decision of the cabinet, we are receiving many calls requesting to highlight the actual gains as per the cabinet decision. The cabinet while approving 78.2% IDA merger from 1-1-2007 denied actual payment till 9-6-2013. It also denied addition payment of other pensionery benefits like gratuity, leave encashment etc. We are trying to narrate the gains and losses below:

PRE 2007 Pensioners:
 Their pension was refixed merging 68.8% IDA earlier. The fixation already done was as below:
A = Old pension as on 31-12-2006 (including commuted amount)
B = DR @ 68.8% of A
C= 30% of A+B
D=  A+B+C  New Pension by Merging 68.8% IDA. (Including commuted amount)
P= Actual take home pension (i.e.   D - Commuted Amount) + 0% DA as on 1-1-2007

Now after 78.2% IDA Merger the refixation will be done as below:
A = Old pension as on 31-12-2006 (including commuted amount)
B1 = DR @ 78.2%% of A
C1= 30% of (A+B1)
D1=  A+B1+C1=  New Pension by Merging 78.2% IDA. (Including commuted amount)
P1= Actual new take home pension (i.e.   D1-Commuted Amount) + DA 0% as on 1-1-2007

Increase in Pension = P1 – P which will be from 1-1-2007 notionally and actually from 10-06-2013. That means these pensioners will get increased pension from the date of fixation by concerned CCA with arrears from 10-06-2013 to that day of fixation by CCA.

But as per the decision these pensioners will not get  Arrears of Pension from 1-1-2007 to 9-6-2013. (77.3 months). Total loss = (P1-P) x 77.3 + DA of the increased amount.  This Arrear is payable by DOT.
 
The pensioners of this category can now calculate the actual individual amounts from the above formula for both gains and lose

Post 2007 Pensioners:
Their Basic Pay was refixed merging 68.8% IDA earlier in 2009. The fixation was as below:
A = Old Basic Pay as on 31-12-2006
B = DA @ 68.8% of A
C= 30% of (A+B)
D=  A+B+C = New Basic Pay on 1-1-2007  (by Merging 68.8% IDA. DA on 1-1-2007 ) + 0% DA

Now after 78.2% IDA Merger :
A =  Old Basic Pay as on 31-12-2006
B1 = DA   @ 78.2% of A
C1= 30% of (A+B1)
D1=  A+B1+C1   (New Basic Pay by Merging 78.2 % IDA on 1-1-2007 Notionally fixed.)
This New Basic Pay ,fixed notionally from 1-1-2007, will be calculated accordingly till date of Retirement taking into account the promotion, annual increment etc. New Notional Pension will be calculated as 50% of the new notional last basic pay drawn.
Therefore Increase in pension will be New Notional Pension – Pension already fixed with commuted amount. This increased amount will be paid actually from 10-06-2013. Arrears from 10-6-2013 to the date of fixation along with the DA for the increased portion will also be paid actually.

The Dues not paid to the Post 2007 Pensioners are on many counts as shown below:-

1) Increased Pension with DA from Date of Retirement to 9-6-2013             --- To be Paid By DOT
2) Leave encashment difference due to new Last Pay Drawn                       --- To be Paid By BSNL
3) Increase in Commutation of Pension as per new fixed Pension.             --- To be Paid By DOT
4) Increase in Gratuity Amount as per New Last Pay Drawn.                         --- To be Paid By DOT
5) Increase of Basic Pay from 1-1-2007 to Date of Retirement with DA.       ---To be Paid By BSNL     (This however has not been paid to serving employees also by BSNL).

The pensioners of this category can now calculate the actual individual amounts from the above formula for both gains and losses.

Thus you can see that our struggle has not ended. There is a long way to go to end the deprivation. Most of the pensioners think that there is nothing wrong in the decision of the Government for paying  the increased pension only from 10-6-2013 as for serving employees also the benefit was paid from 10-06-2013. This is a generous thinking. The service employees who got the benefit of 78.2%, when retiring is getting his pension and pensionary benefits as per pay fixed by merging 78.2% IDA from his date of retirement, then why the same should not be paid to the pensioners retired before 10-06-2013? What the serving employees did not get is their pay arrears from 1-1-07 to 9-6-2013, the same (as mentioned in (5) above) may also be kept with held for post 2007 pensioners till such time it is paid to serving employees but the pensionary benefits as mentioned in (1) to (4) above for post 2007 pensioners and pension arrears from 1-1-07 to 9-6-2013 for pre 2007 pensioners also should be paid immediately in accordance with letter and spirit of various judgments delivered by Hon'ble Supreme Court regarding payment of pensionary benefits.

This deprivation to the pensioners has not been protested so far by any other Associations except AIRBSNLEWA and AIBSNLEA. We wrote repeated letters citing supreme court judgments but DOT overlooked them. We assure our members that we along with the help of AIBSNLEA are committed to settle the issue. Pl keep a watch on the developments and cooperate with us as always.

05.07.2016:     CABINET NOTE ON 78.2% IDA MERGER FOR PENSIONERS:
Our President Com Rakeshji spoke to DDG(Estt.), DoT today over telephone in the morning as to what queries/ clarifications were sought from Cabinet Secretariat, as per the note sent by Cabinet Secretariat to Hon’ble MOC(IT) on 29/6/2016 and the same was forwarded to the office of DDG(EStt.) on 29/6/2016 and a meeting was reportedly held in his office on 04/07/2016  for resolution of the matter.  DDG(EStt) deemed it inadvisable to discuss this issue over phone and hence  our President along with Com Kishanji GS met  DDG (Estt) at Sanchar Bhavan.
 
DDG(EStt) informed us  in response to our queries  that Cabinet Note Could not be  taken up for consideration on 29/6/2016. Regarding queries/ clarifications  sought by Cabinet Sceretariat, he was not very specific but he stated that they have answered to all the queries that they could answer (presumably relating to previous Cabinet Decision on 60:40 issue and reasons for its reversal.) Some queries, which could not be answered have been left unanswered. He also added that "We have done our best to explain our viewpoint and we are  keeping  our fingers crossed and we are  hopeful  for a positive resolution." (Reply to queries was reportedly  sent to Cabinet Secretariat on 04/072016 A/N ).
 
After reply to queries from cabinet Secretariat, the concerned file/ part file was lying with Establishment Wing. Director(Estt.) was tight lipped about the contents and context of the query, which was quite understandable. These details shall be communicated  in  a day or two after due verification.
04.07.2016:     CABINET NOTE ON 78.2% IDA MERGER FOR PENSIONERS: Com Rakeshji, our president enquired the status today. It is gathered that the file has been returned on 29th June to MOC and then to Secretary (T), Member (S), DDG (Estb) on same day. Since then the file is with DDG (Establishment) DOT. It is also gathered that today some meeting is being held in his chamber on this issue. It is therefore presumed that the file might not have been placed to the Central Cabinet and some objections/clarifications are raised by the Cabinet Secretary / his Secretariat , which is presently being processed by DDG (Estb).
We are trying to get more details and shall intimate as soon as available.   
01.07.2016:     IDA INCREASE 2.4% FROM JULY 2016.    
 30.06.2016:     CABINET NOTE ON 78.2% IDA MERGER FOR PENSIONERS: The Cabinet Memo has been submitted to Cabinet Secretariat on 17-06-2016 for consideration of the cabinet. The Central Cabinet meets every Wednesday to discuss such issues. Yesterday they cleared the proposal of implementation of 7th CPC but perhaps 78.2% issue was not on agenda. We expect that in the next meeting on 6th July the issue may be discussed. Let us hope that the Cabinet will clear the issue soon favorably.

30.06.2016:     Com Prahlad Rai Chief Mentor, AGS(Fin)/AIBSNLEA, CS AIBSNLEA Haryana Circle and Kishan Singh GS with FS, AIRBSNLEWA met Director (HR) on 28-06-2016 and felicitated on behalf of 2nd AIC of AIRBSNLEWA since she could not  visit Mysore.  Director (HR) explained that she was to attend the conference at Mysore but due to some unavoidable reason she could not attend  the conferences.  However, while appreciating the problems of BSNL pensioners,  she informed that for submission of medical bills through ERP of BNSL Pensioners was examined but it is not possible  through ERP, hence CGM ITPC, Pune has been asked to develop a module for BSNL Pensioners for feeding their medical claims online and to know the status of bills payments.  ITPC, Pune has assured to develop the module within two months time.

Earlier During the open session of AIBSNLEA at Mysuru on 17-6-2016, CMD, Director(CFA) and GM(SR) BSNL was felicitated by AIRBSNLEWA.

30.06.2016:     7th CPC Report cleared by Union Cabinet:

The countdown for the implementation of  7th Pay Commission recommendations is over as the Union Cabinet on Wednesday cleared the final report made by the secretaries panel on Pay Commission recommendations

Highlights of the Cabinet approval on 7th CPC Report:

- Financial impact of pay hike: Rs 73,650 crore to be accommodated in the general budget and Rs 28,450 core by railway budget.

-The rate of annual increment retained at 3 percent.

-24 percent hike in pensions.

- The 7th Pay Commission report on revised pay will be effective from January 1.

- The Indian Army will benefit the highest with the cabinet approving hike in its salary from Rs 21,000 to Rs 31,500.

- Gratuity ceiling of employees will be doubled from Rs 10 lakh to 20 lakh.

- The cabinet cleared 23.55 percent hike in salary as recommended by the 7th Pay Commission.

- The entry level pay recommended to be raised to Rs 18,000 per month has also been accepted.

published an extraordinary edition of the Gazette of India on dated 09.06.2016 notifying the constitution of 3rd Pay Revision Committee (3rd PRC) comprising of the following:

Chairman: Justice Satish Chandra (Retd.)

Members: (1) Shri Jugal Mohapatra, Ex-IAS Officer (2) Prof. Manoj Panda, Director, Institute for Economic Growth, Delhi and (3) Shri Shailendra Pal SIngh, Ex. Director (HR), NTPC Ltd. Secretary, DPE shall be the Ex-Officio Member and Jt. Secretary/Addl. Secretary, DPE shall be the Member Secretary.

The Committee will make its recommendations to the Government within a period of six months from the date of its constitution and have headquarters in Delhi. 10.06.2016:     Faridabad Branch of AIRBSNLEWA formed. In a meeting held today, Faridabad Branch is formed with 20 Life Members. Com President and Com G S attended the meeting. 
08.06.2016:  SECRETARY (T) IS OUT OF STATION: There is no development. The 78.2% IDA file is still in Secretary (T) 's chamber. He is out of station and expected to be back on next Monday (13-06-16). On 23-05-16 we reported that there will be approximately a time delay of one month for sending it again to cabinet secretariat and some Association passed oblique comments on our estimation. Now one more week and one month will be completed.   
07.06.2016:THE FILE IS STUCK UP WITH SECRETARY (T) : Com Rakesh Srivastava President AIRBSNLEWA enquired at 17.00 hrs today and learnt that the file with revised cabinet memo on 78.2% issue is still in the chamber of Secretary (T). The file is waiting for his signature since 1-6-2016.
01.06.2016: STATUS OF 78.2% ISSUE : Today morning the file is with Secretary(T). If he signs the file today then it may go to the Cabinet secretariat tomorrow.   

01.06.2016:  Meeting with GM (Admn) BSNL CO New Delhi:

Com Prahalad Rai Chief Mentor and GS AIRBSNLEWA Shri Kishan Singh met GM (Admn) BSNL CO and discussed regarding long pending problems of pensioners:

 

A. OUTDOOR MEDICAL BILLS REIMBURSEMENT: We requested to streamline the payments of BSNL pensioners medical claims through ERP or web provision wherein pensioners may submit his medical outdoor claims online and can monitor the status of their medical claims.  GM (Admn) appreciated our concern and mentioned that recently Director (HR) has also directed to settle the pending issues of BSNL pensioners as raised by AIRBSNLEWA.  He assured to discuss the matter with ED (CA)/Sr.GM (IT) for creating a software in this regard so that BSNL pensioners can feed online and monitor the status of their medical claims

 

B. INDOOR MEDICAL TREATMENT BILLS: In this regard we requested that the committee constituted should hear the voice of BSNL Pensioners also. The places where the empanelled hospitals are not available, TPA system like other PSUs linking with LIC as done by CGHS may be introduced.  GM (Admn) assured to look in to the matter

 

C. ALLOWING FREE CALLS AS PER BSNL ORDER IN CONCESSIONAL TELEPHONES: Free calls allowed in the concessional telephones are 500+50 calls which should be 500+220calls to BSNL as per order of BSNL dated 12-07-2007. We requested that the orders to this effect may kindly be issued immediately. Further, the free calls allowed should be the call made in local and national networks.  GM (Admn) informed that the matter is under consideration and shortly necessary orders will be issued

 

D. ALLOWING NIGHT CALLING FACILITY IN CONCESSIONAL TELEPHONES: The free Night Calling Facility as introduced in land phones has not been extended to concessional land phones for pensioners which are not coming under service telephone category. We requested that this may kindly be introduced for the concessional land phones for pensioners also. GM (Admn) informed that matter is under consideration and shortly necessary orders will be issued

 

E. TRANSFER OF SERVICE BOOKS OF BSNL PENSIONERS TO DOT CELLS AFTER RETIREMENT: After retirement all BSNL pensioners draw their pension from DOT. All further pension revision etc. are to be carried out by DOT cells of respective CCAs. Hence it will be appropriate to transfer the custody of the Service Books to DOT for proper maintenance. It may be noted that DOT cells are maintaining the service books electronically for safety and security. GM (Admn) informed that matter is under consideration in the Establishment Cell of BSNL C.O.

 

ABOVE ISSUES WERE TAKEN UP BY AIRBSNLEWA SOMETIMES BACK AND ARE BEING CONSTANTLY PURSUED. NOW AS THE ISSUES ARE COMING TO THE MATURITY, SOME OTHER UNIONS/ASSOCIATIONS ARE BECOMING VOCAL AND UPLOADING NEWS IN THEIR WEBSITES ON THESE ISSUES. THEY ARE WELCOME AS WHATEVER THEY DID WILL COME TO THE BENEFIT OF PENSIONERS ONLY.

 

31.05.2016: STATUS OF 78.2% ISSUE : Yesterday the file has gone to Member(F). Till today 12:30 PM it is with Member(F).      
27.05.2016: STATUS OF 78.2% ISSUE : As directed by Cabinet Secretariat, Attachments to the cabinet note i.e old cabinet memos, orders etc have been removed and a gist of them now attached and was send to Dir (Est) by pension cell yesterday. Today the file is with Member(S) who is on leave. This has to be signed by the Member (F) and Secretary (T) before sending to cabinet secretariat. If everything goes fine the shortened Cabinet Memo may go to the cabinet secretariat next week.     
27.05.2016: Raising the free limit of concessional Telephones: The issue is under active consideration. GM (Admn) BSNL  asked for some information from ITPC   READ  
 23.05.2016:  CABINET SECRETARIAT WANTS THE CABINET NOTE TO BE CRISPY AND SHORT:  Com Rakesh Srivastava President AIRBSNLEWA reports AFTER enquiring that The Cabinet Secretariat wants the Cabinet note on 78.2% IDA merger to be crisp and short in place of the existing voluminous one. Therefore the said cabinet note has to be redrafted with fresh hindi translation and again to be signed by all bureaucrats before sending it to the cabinet. That means wait for at least one more month.
 23.05.2016:   Our AGS Comrade Amit Kumar Gupta, who had earlier submitted number of RTI queries on our Pension issue, had submitted another RTI six month ago (21-12-2015) asking some more questions based on the information received out of his earlier queries.  Pension Contribution collected from BSNL serving employees is deposited in Consolidated Fund of India as per extant rules.
After this reply the question which comes to everybody's mind:-

1) Then why Hon'ble MOC while replying the question raised in lok sabha did not mention that the pension is paid from the Consolidated Fund of India ?

2) Why then there is so much of correspondence on question of fund provision for granting 78.2% IDA for pensioners ?

3) Why DOT has asked for annulment of 60:40 provision in the Cabinet Memo ?

4) If the pension funding is from Consolidated Fund, then why 78.2% IDA is not given to pensioners even after 3 years?

5) While replying the DOE's querry in the tear 2014, why it was not pointed out to DOE that the pension is paid from consolidated fund of India. (No 40-13/2013 Pen(T) dt 11-7-2014)

1751. SHRI M.B. RAJESH:

Will the Minister of COMMUNICATIONS AND INFORMATION TECHNOLOGY be pleased to state:
(a) the existing rules/guidelines for the pension and revision of pension of the DoT employees absorbed in BSNL;
(b) whether any restriction is placed on the pension payment of these officials; and
(c) if so, the details thereof and the reasons therefor?

                             THE MINISTER OF COMMUNICATIONS AND INFORMATION TECHNOLOGY
                                                  (SHRI RAVI SHANKAR PRASAD)

(a) Pension of BSNL employees is regulated under sub-rule 37-A of CCS (Pension) Rules, 1972. The Department of Public Enterprises issues instructions/orders for revision of pay of employees in Central Public Sector Enterprises which are extended to the working employees of BSNL from time to time. On the basis of the pay revision orders issued by Department of Public Enterprises, pension/family pension of DOT employees absorbed in BSNL are revised with the approval of Cabinet from time to time.

(b) &(c) As stipulated in sub-rules 22 & 23 of Rule 37-A of CCS (Pension) Rules, 1972, in the case of BSNL, the pensionary benefits including the family pension shall be paid by the Government and the Government shall specify the arrangement and manner including the rate of pensionary contribution to be made by BSNL and the manner in which financial liabilities on this account shall be met. As per sub-rule 24 Rule 37-A of CCS (Pension) Rules, 1972, the arrangement thus worked out shall also be applicable to the existing pensioners and the employees who are deemed to have retired from Government service for absorption in BSNL. Cabinet in its meeting dated 27-01-2005, approved (Cabinet Note dated 14.01.2005) the payment of pension by the Government in respect of employees of DoT/DTS/DTO who retired prior to 1.10.2000 and those who have worked/are working in BSNL on deemed deputation and those who are absorbed in BSNL subject to the following conditions:
(i) The annual pension liability of the government shall not exceed 60% of the annual receipts to Government from the following items:
a. Dividend income from MTNL/BSNL.
b. License fee from MTNL/BSNL.
c. Corporate Tax/excise duty/service tax paid by BSNL.
(ii) Any amount exceeding (i) above shall be borne by BSNL.
(iii) Existing system of payment of pension would continue
(iv) Pensionary contribution from BSNL would be made to Government as per FR-116.
(v) Employees recruited directly by the BSNL on or after 01-10-2000 shall not be covered under this decision.

17.05.2016:  IT IS LEARNT FROM MOST RELIABLE SOURCES THAT THE CABINET MEMO ON 78.2% IDA FIXATION FOR PENSIONERS IS BEING RETURNED BY CABINET SECRETARIAT WITH SOME COMMENTS/OBSERVATIONS
12.05.2016:   Meeting with Director (HR), BSNL Board, New Delhi ON 10-5-2016

Com Prahlad Rai Chief Mentor and GS AIRBSNLEWA Sh. Kishan Singh met Director (HR) and discussed regarding settlement of the genuine pending issues of BSNL Pensioners already discussed in the meeting held on 11-4-2016 with Director (HR):

(a) For Outdoor medical Bills Reimbursement:- They requested that after introduction of ERP, the medical claims for serving employees has been streamlined, but the BSNL Pensioners are kept out of the ERP, hence their claims are still manually processed which is causing delay and the progress of claim settlement is concern to the Pensioners.

(b) Cash less Indoor treatment: For indoor medical treatment other than Delhi in most of the cities, empanelled hospitals for treatment on cashless basis are very few.  TPA system as is available in other PSUs or linking with LIC as done by CGHS may be introduced.

(c) Free Call limits on concessional telephones to retired DoT/BSNL employees: Allowing free calls as per BSNL order dated 12.7.2007 in concessional Telephones should be 500+220 calls instead of 500+50 calls.  Also the free calls allowed should be the call made in local and national networks.

(d) Allowing Night calling facility in concessional telephones- The free Night calling facility as introduced in landline phones has to be extended to concessional land line phones for BSNL Pensioners.

(e) Transfer of Service Books of BSNL Pensioners to DOT Cells after Retirement as the Pension is being paid by DOT.  All further pension revision etc. has to be done by CCA units of DOT only.

 

After detail discussions Director (HR) assured for early settlement of all above issues.

 

09.05.2016: CABINET MEMO ON 78.2% IDA MERGER FOR PENSIONERS HAS BEEN SENT TO THE CABINET: It is learnt today that on Friday (6-05-2016) it self the much waited Cabinet Memo has been sent to the Cabinet Secretariat and PMO by the Pension cell of DOT. It is also learnt that the memo contains the following proposal for approval of Union Cabinet. 

1)      For Pre 2007 Pensioners: Their pension will be notionally revised by merging 78.2% IDA as on 1-1-2007 but the revised pension will be actually paid from 10-06-2013

2)      For Post 2007 Pensioners: Their pay will be notionally revised from 1-1-2007, which will also revise their last pay drawn notionally. The pension will be revised accordingly from their date of retirement but will be actually paid from 10-06-2013.

3)  Annulment of following provision which was earlier approved in 2005 by the Cabinet:

"the annual pension liability of the government in respect of employees of DoT/DTS/DTO who retired prior to 1.10.2000 and those who have worked or working in BSNL on deemed deputation and for those who are absorbed in BSNL, shall not exceed 60% of annual receipts to the Government from (i) Dividend income from MTNL/BSNL, (ii) Licence fee from MTNL/BSNL, and (iii) Corporate Tax/Excise Duty/Service tax paid by BSNL. If the annual pension liability exceeds the figure 60%, the balance amount is to be paid by BSNL.”

05.05.2016:17-45 hrs    CABINET MEMO ON 78.2% IDA MERGER FINALLY GOING TO CABINET : As reported earlier, after signature the file has come back to Establishment/Pension Cell for Secretary (T) office at 17-30 hrs. Tomorrow it will be sent to Cabinet Secretariat/PMO for further consideration of the Cabinet Memo on 78.2% IDA merger for pensioners from 1-1-2007 but actual effect from 10-06-2013 and annulment of 60:40 pension sharing system. It may be noted that instead of replying the queries of DOE to DOE, it is included in the cabinet memo and being sent to Union Cabinet for their consideration
05.05.2016:   Com Prahlad Rai Chief Mentor met today with Director (Estt), DoT and discussed regarding:

A. Status of 78.2% IDA Pay fixation benefit to BSNL Pensioners: He requested for early sending of the Cabinet Note to the Union Cabinet for approval as it has already been approved by Hon'ble MoC & IT. Director (Estt) informed that the Cabinet Note has been send to the Secretary (T) for his signature and shortly it will be sent to Union Cabinet for approval. He further met in the Secretary (T) office and inquired about the Cabinet Note status. It was confirmed that the Cabinet Note is available in their office for Secretary (T) signature and possibly today it may be sent to the Pension Cell for further necessary action.

B. CGHS medical facility to BSNL/MTNL Pensioners: Director (Estt) informed that still the matter is pending in the Ministry of Health for decision in this regard. He assured to further contact the concerned officers in the Ministry of Health for early decision and making CGHS Cards to BSNL/MTNL Pensioners.

03.05.2016:     WHERE IS THE FILE ??   Com Rakesh Srivastava again enquired at 16.30 hrs (03-05-16). As per Sr PPS to Secretary (Telecom) the file is still with secretary as fer file tracking system, but the file is not located physically in his office. The file has not gone to Member(S) either. Then where it is ? As per our source it is with Secretary (T) only.    
03.05.2016:     The Final Cabinet Memo is yet to be signed by Secretary(T) : Today (3-5-16) Com Rakesh Srivastava President AIRBSNLEWA enquired with the office of Secretary(T) at 10-30 Hrs and learnt that the file is still in the chamber of Secretary awaiting his signature. The news given by some association that the file is already signed ia a premature one and not correct.     
02.05.2016:      Com Rakesh Srivastava President enquired the status of 78.2% IDA merger case with Establishment section of DOT. It is learnt that the final Cabinet Memo has been sent to Secretary DOT on 28-04-2016. It is yet to be signed by him. After his signature the file with the proposal of extending the benefit of 78.2% IDA merger for pensioners from 1-1-2007 but effecting from 10-06-2013 and also annulment of 60:40 pension sharing will go to cabinet secretariat for consideration of union cabinet .   
28.04.2016:     LODGE YOUR GRIEVANCES ON MEDICAL BILL AND OTHER PENSION RELATED ISSUES WITH CPGRAMS (Centralised Public Grievances Redress And Monitoring System) at www.pgportal.gov.in  :  CPGRAMS is a powerful mechanism where any individual can focus their grievances which will be immediately forwarded to concerned department and is being monitored by Department of Administrative Reforms and Public Grievances regularly till settlement of the issue. Let the Pensioners use this tool to redress their grievances related to delay payment of medical bills and any other pension related issues including gratuity and leave encashment.
For Pending Medical Bills (Indoor and Outdoor)    : Log on to www.pgportal.gov.in -> go to "lodge your grievance" -> public grievance -> check "i agree" and then submit. The Grievance form will appear in the screen. Select  Department as "Telecommunication" , then select "Bharat Sanchar Nigam Limited" then type of grievance as "harassment". There after fill in your name with designation as "Retd ...../ name of circle" (eg Retd AO / Maharastra Circle, Pune). Fill up address and phone nos as directed and then in the Grievances Box mention details of the case. Your HR NO, Circle SSA/Area, No of bills pending, From which date they are pending, Total pending amount etc in details. Pl do not use spl characters as mentioned. 25.04.2016:      The Final Cabinet Memo on 78.2% IDA Merger and removal of 60:40 pension sharing provision, is under preparation at the Establishment Section of DOT after its approval by MOC. The work is however delayed as the concerned officers are on leave till this month end .       
19.04.2016:     Meeting with  DDG (Estt), DoT :

Com Prahalad Rai along with Shri M.L. Ostwal, CS, AIRBSNLWA met Shri S.K. Jain, DDG (Estt), DoT regarding the progress of the case of 78.2% IDA fitment to BSNL Pensioners. DDG (Estt) informed that the Cabinet Note regarding 78.2% IDA fitment to BSNL Pensioners has been approved by Hon’ble MoC &IT and Secretary (T) and the file containing the note has been reached to the Pension Cell of DoT for sending the Cabinet Note to the Union Cabinet for approval.

13.04.2016:   10.30 AM : Hon'bl MOC HAS SIGNED THE 78.2% FILE WITH CABINET NOTE YESTERDAY AFTERNOON AND SEND IT TO SECRETARY (T). THE FILE IS NOW IN THE CHAMBER OF Secy (T) who is on leave today. Remaining days of this week are holidays hence next movement expected only on next Monday.

12.04.2016:  It is learnt that till lunch hours the file of 78.2% IDA fitment has reached to the office of Hon'ble MOC&IT and also put on the table of Hon'ble MOC&IT............................

11.04.2016:   Meeting with Director (HR) on various issues related to BSNL pensioners:As scheduled, the meeting took place today at the chamber of Director (HR), wherein GM (A) and G.M. (Estt) were also present.  From the association side President, General Secretary, AGS (Engg), AGS (C/E/Ar/TF) from AIBSNLEA and President, General Secretary, AGS –I and AGS – II of AIRBSNLEWA represented.

The discussions took place on the agenda submitted earlier.  The brief of the discussion is as follows:

1.     For outdoor medical bill re-imbursement:  The Association  pointed out that many circles are making the re-imbursement of medical bills of the retired employees abnormally delayed, more over in the recently developed  ERP system the entry of the medical bills of the pensioners are made only at the last stage before the payment. Otherwise it is being done manually as was done in earlier situation.  Therefore, the pensioners are not in a position to track the medical bills online which is available to the serving employees. The condition of the pensioners suffering from acute diseases like cancer, dialysis, etc. are pathetic. The association suggested the following measures to be implemented.

·    Pensioners will prefer their claims in usual way and submit it personally or by speed post / courier as per their convenience.

·    On receipt of the claim the Accounts office shall immediately enter the claim details in the ERP system on the same day.  After entry the system will generate “a claim no. and intimate the same to the concerned pensioner by SMS”.

·    The pensioner can view the progress of the claim in the portal with help of the claim no.

·    Additionally system will generate SMS whenever the claim processed at each stage of settlement.

·    Finally the payment details against the claim numbers to be intimated to the pensioners so that he/she understand which claim is paid.  The information to be provided in the portal also and claims are to be settled within a specified time limit as in the case of serving employees.

·    The ERP package and BSNL intranet to be suitably modified to cater the above provisions.

Director (HR) and the G.Ms present in the meeting highly appreciated the suggestions and decided to implement the same at the earliest.  Director (HR) asked ED (CN) whether such provisions can be made in the ERP.  ED (CN) informed that the same can be discussed with ITPC wing.  Director (HR) requested to have the discussions immediately, wherein our representatives from the associations will also be present.

2.  For Indoor Medical Treatment:  Association pointed out that other than New Delhi, empanelled hospitals for treatment on cashless basis is practically non-existence  in most of the circles.  

Director (HR) pointed out that, she is aware of the problems and proposal to introduce medi-insurance is under scrutiny and is under active consideration of the BSNL management.  She asked G.M. (A) to decide the issue as quickly as possible.  Association further pointed out that in the committee formed, there is no representative either from the executive association or from the pensioners.   Director (HR) immediately instructed to include both the G.Ss of the executive associations in the committee.

3.  Allowing free calls as per BSNL order in concessional telephones:  Free calls allowed in the concessional telephones for the retired executives are 500 + 50 calls , which should be 500 + 220 calls to BSNL as per BSNL order dated 12.7.2007.  Association pointed out that this could be implemented straight away as the provision already exists in the BSNL’s own order.

Director (HR) asked G.M. (A) to examine and settle the issue immediately.

4.  Allowing night free calls in the concessional telephones: Free night calling facility as introduced in the landline phones has not been extended to the concessional telephones of the pensioners which are not coming under service telephone category. 

Director (HR) asked G.M. (A) to examine and put up the issue immediately. 

5.    Transfer of service books of BSNL pensioners to DoT Cells after retirement:  It was pointed out that after retirement, the service books of the CDA pensioners are transferred to concerned CCAs, but for IDA pensioners, it is kept with BSNL only.  For proper upkeepment of the service books, the same may be transferred to the concerned CCAs, who are presently maintaining it electronically for safety and security and also to ensure timely settlement of the future pension revision / family pension settlement, etc.

Director (HR) instructed G.M. (Estt) to examine the issue and find out the present rule position on the subject.

The meeting was held in a  very much co-ordial atmosphere.  Director (HR) categorically mentioned that she personally does not like that the pensioners after their retirement should visit the offices for their claim settlement.  She assured to settle all the issues and expected that in the next meeting she will find smiling faces of the pensioners.  She also requested Com. Prahlad Rai to regularly follow up the issues with her till the issues are settled.

11-04-.2016:    Good News....... It is learnt that Secy(T) has cleared 78.2% file along with Cabinet Memo. The file will now go to MOC&IT and after his approval will be sent to Cabinet for approval.

02-04-.2016: Status of Cabinet Note regarding 50% IDA Merger amounting to 78.2% IDA as on 1/1/2007 for BSNL Pensioners retiring between 1/10/2000 and 09/06/2013:-
After clarifying the queries raised by Secretary(T) on MTNL issue, regarding grant of 50% IDA  merger  amounting to 78.2% IDA as on 1/1/2007  the Cabinet Note on this issue was submitted to Secretary(T) on 23/3/2016, but the same is still awaiting approval/ concurrence from Secretary(T) for further approval from Hon’ble MOC & IT and the UNION Cabinet.
G.S.  and President  AIRBSNLEWA along with GS, AIBSNLEA sought personal meeting with Secretary(T) on 14th March 2016 on this very issue, wherein Secretary(T) advised our Office Bearers to seek a proper appointment through a written request. Immediately G.S., AIRBSNLEWA submitted  a written request in office of Secretary(T). This was  followed by two reminders to Secretary(T)  by our President through e-mail on 28th March and 31st March 2016 with no positive response from the office of Secretary(T).
Today on 1st April 2016, GS and President AIRBSNLEWA went to Sanchar Bhavan and again  sought a personall meeting / appointment with Secretary(T), which was deferred to next week by Secretary(T). But we insisted upon meeting Secretary(T) today itself and waited to meet him in his  office.
We met Secretary(T) in the visitor’s lobby and told  Secretary(T)  that we have been seeking meeting/ appointment  with him over a period of  last three weeks with no avail. The pensioners are getting restive and the issue of 50% DA Merger amounting to 78.2% IDA as on 1/1/2007 needs early resolution, for which a duly prepared cabinet Note was awaiting his approval.
Secretary(T) replied that he was fully aware of our problem and was trying to look into the matter  and resolve it at an early date. We pointed out that the issue was awaiting settlement over a priod of last three years. Secretary) in turn responded that we could not apportion entire blame of three years delay over his head. Very true, we replied but we expected him to resolve the issue at the earliest. Secretary(T) replied in the affirmative with assurance to approve the Cabinet Note and get this issue resolved at the earliest.

Let ws hope that this time it will get the nod of the Secretary (T) and the file will reach MOC without any further trouble            
24.03.2016: Status of Cabinet Note regarding 50% IDA Merger amounting to 78.2% IDA as on 1/1/2007 for BSNL Pensioners retiring between 1/10/2000 and 09/06/2013:-

Benefit of 50% IDA merger w.e.f. 1/1/2007 to all Employees of BSNL vide DOT Memo no.61-01/2012-SU dated 10th June 2013 was granted by  Govt. of India w.e.f. 10th June 2013.

The proposal to extend the benefit of 50% IDA merger to BSNL Pensioners, (retiring between 1/10/2000 and 9/6/2013),   amounting to 78.2% IDA (as on 1/1/2007) was moved by DOT in January 2014 for approval from DOP/DPE/  Dept. of Expenditure. After several rounds of consultations / clarifications  the proposal moved by DoT was approved and concurred by Hon’bel MOF  vide DOE OM No. 582/EV/2014 dated 15/10/2014 with a caveat that DOT should seek Cabinet Approval as well  for granting benefit of 50% IDA merger w.e.f. 1/1/2007 to all BSNL Pensioners retiring between 1/10/2000 and 09/06/2013 as granted to working Employees of BSNL vide DOT Memo no.61-01/2012-SU dated 10th June 2013.

Cabinet Note was duly prepared by DoT and sent to DOP/ DPE/ Deptt. Of Expenditue and Ministry of Law in F.Y. 2015-16, incorporating one additional issue of insufficient funds for payment  of BSNL Pension under cabinet Decision dated 27/1/2005, which limited Govt. liability to 60% of Revenue Receipts from BSNL, and  seeking waiver/ annulment of Cabinet decision dated 27/1/2005. The  issue of funding of BSNL Pension should not have been combined with issue of 50% IDA Merger as granted vide OM dated 10th June 2013. It should have been dealt separately by DoT at a later date. This caused further delay and Deptt. Of Expenditure raised many queries in August 2015, which have already been elaborated in one of our earlier WRITE Ups on our web site..

DoT took another one  year or so in finalizing the reply to queries raised by Deptt. Of Expenditure, but in their wisdom,   did not consider  it appropriate to send the  reply to queries to Deptt, of Expendityure for further action.. Instead DoT thought that a better strategy would be   to send the Cabinet Note over this issue  directly to Union Cabinet for their consideration and clearance.

This Issue was apparenrly resolved internally between Member(F)  and Secretary(T)  in DoT and the Cabinet Note was already submitted in the month  of January 2016  to Secretary(T) / MoC  for their approval and further decision  by the Union Cabinet.  But  a change of guard took place  in DoT. Sri Rakesh Garg,  then Secretary(T) was transferred to another Ministry  and  Sri J.S.Deepak, I.A.S.,  new Telecom. Secretary  took charge on 1st February 2016 as new Telecom. Secretary,   

In response to some representations regarding  grant of  50% IDA Merger, wherein  some   MTNL Associations/ Unions have demanded parity with BSNL, which is mandated  to be granted to them by leveling down MTNL scales  under 3rd PRC w.e.f. 1/1/2017 in accordance with Cabinet Decision on Govt.  Pension to MTNL Employees at par with BSNL. Secretary(T) has raised some queries on 12/02/2016  regarding admissibility of 78.2% IDA to MTNL Employees/ Pensioners based on representations of MTNL Associations/ Unions forwarded by MTNL to DoT.  

Establishment Wing of DoT has already clarified to Dett. Of Expenditure  that benefit of 50% IDA Merger to BSNL Pensioners can become an issue  only after the same benefit is  granted by MTNL to its existing Employees in MTNL. Because  MTNL Employees have not yet been  extended the benfit of 50% IDA Merger, amounting to 78.2% IDA as on 1/1/2007,  the same can not be given to MTNL Pensioners at this stage, because entitlement to pension is based on the quantum of last pay drawn.

The file was doing rounds in Establishment/ Finance/ PSU Wings in DoT and after six weeks of deliberations the opinion  rendered by Establishment Wing is supported by PSU Wing and Finance Wing. Curretly file has returned to Pension Cell of DoT snd is under submission to DDG(Estt.)/ Member(S)/ Secretray(T).

Hopefully all doubts/ queries  raised by Secretary(T) have been answered during six weeks of internal deliberation and the Cabinet Note is expected to be approved by Secretary(T)/ MOC & IT in last week of March 2016 for onward journey to Union Cabinete   ----  Rakesh Srivastava, President, AIRBSNLEWA

PROVISION FOR FUNDING OF PENSION FOR DEEMED DOT RETIREES /  BSNL ABSORBEES  FINDS SPECIFIC  MENTION IN ALL THE UNION BUDGETS FROM 2006-2007 ONWARDS TO 2016-17

We have been informing our members about the developments happening  on our pension issue since 2003 . Through different write-ups we have been  constantly educating our members about the developments and happenings. Our members are aware now, how due to constant pressure of the Finance Ministry/Dept. of Expenditure  the 60:40 pensionary  
load shairng clause was introduced and how our pension was got   linked by DoT/ Deptt. of Expenditure with the deposits made by BSNL under different accounts. The 50% IDA merger issue amounting to 78,2 % IDA as on 1/1/2007 is still struck up on the funding issue and presently the cabinet memo is under submission along with proposal of annulment of 60:40 load sharing clause .
 
Now after placement of the union budget 2016-2017, when we went through the budgetary documents we found that Department of Telecommunications has placed a demand for grants required for various expenses till 31st march 2017. In the said statement Rs 8932.00 crores has been asked for discharge of the responsibility of pension and pensionary benefits. Further in the explanatory note it is also specifically mentioned that this includes pensionary benefits of the employees of the department Telecommunications together with employees absorbed in Bharat Sanchar Nigam Ltd. (`8,932crore).
 
Out of curiosity  we searched the budget proposals of earlier years. And found that from 2006-2007 onwards similar provisions existed  in every years budget  under Telecom. Budgetary grants. However after FY 2000-2001 and prior to FY 2006-07 this item was not mentioned under Telecom. Budgetary grants.
 
Now the question rises that when there is a budgetary provision for payment of pension of BSNL absorbees why so much file processing is being done?  Why Department of expenditure is asking so many queries about the fund provisioning ? Why there is a need of annulment of 60:40 ? Why such provisions are mentioned in the cabinet memos,  and why the issue 78.2 % is  delayed so much ?
 
These are the questions DOT should answer. We are placing the information to all pensioners as a responsible association. They may exercise their channels to get the mystery solved.

03-03.2016:  78.2% ISSUE ---  SECRETARY (T) RETURNED THE FILE: Com Rakesh Srivastava, our President  has enquired the status of the file containing the cabinet note today morning. It is learnt that yesterday the file was sent back to Member (F) DOT who  sent  the file to DDG(B&PF) today morning.  It is also learnt that the query this time is whether to include MTNL in this proposal and subsequent implications thereof.

26-02.2016:  Special General Body meeting of UP (East) Circle  
Marvelous  and well organized General body meeting of  “ALL INDIA RETIRED BSNL EXECUTIVES’ WELFARE ASSOCIATION” UP(East) Circle  was held on 23rd February 2016 at “Essence Banquet Hall” ARYAN RESTAURENT , Opposite Governor House, Hazratganj Lucknow .
After observance of two minutes silence in memory of departed members the meeting started with the opening remark of Circle President. After that all PHQ Leaders, members and Guest specially Shri Satish Joshi, Area head along with his team ICICI Securities were welcome by Circle Secretary Com Pallab Bose.
Com Pallab Bose Circle Secretary apprised members of UP(E) circle in detail about the latest development on Status of the Cabinet Note like 78.2% IDA merger, 60-40 issue, Medical issues were explained to the pensioners. There was nice interaction with them after the deliberation which further cleared many doubts.
Com Bose also apprised the members that “AIRBSNLEWA” is an only Association who is sincerely perusing the issues of Retired Executives of BSNL at CHQ level as well as Circle level. He conveyed his sincere thanks to CHQ Leader Com Rakesh Srivastava President, Com Kishan Singh GS, Com Amit Gupta, AGS for their sincere pursuance of our pending issues.

Open session  was attended by hundreds of retired  executives and addressed by Com S.M.Abbas, Circle President, Com Pallab Bose Circle Secretary, Com C.S.Verma, Finance Secretary, Com S.K.Awasthi Circle Vice president & Com R.J.Pandey Dist.President AIBSNLEWA Lucknow. 10 new pensioners took enrollment as Life Members
 Circle secretary also appealed to each and every member to increase the membership to strengthen our CHQ hand He also assured to members that he will struggle to protect every right of the retired executives.
Com Ram Janam Pandey and Com P.K.Dixit appealed to all retired executives of UP East Circle to come together in one platform in the interest of our retired Executives.
Circle Secretary thanked com P.K.Raje Org Secretary, Com G.N.Gupta, Com D.N.Verma & Com A.K. Tripathi, and ACS for organizing the meeting. Com Bose Circle Secretary assures that a similar meeting will be organized very soon.
The Open Session ended with vote of thanks followed by National Anthem.  The meeting lasted for about 4 hours.

25-02.2016:  78.2% ISSUE ---  SECRETARY (T) NOT IN INDIA:      

Com Prahlad Rai Chief Mentor and GS AIRBSNLEWA Shri Kishan Singh met Member (S) DoT and DDG (Estt) DoT yesterday and discussed regarding implementation of 78.2% IDA Pay fixation case of BSNL Pensioners. Member (S) informed that Cabinet Note in this regard is ready and it will be sent to cabinet after the approval/signature of Secretary (Telecom) on his returning from Barcelona (Spain) in the next week.

 

They requested DDG (Estt) DoT for allowing CGHS medical facility to BSNL/MTNL Pensioners.  He informed that the matter is under consideration with Ministry of Health. Next week meeting is fixed up with Ministry of Health Officer to discuss the matter for extending the CGHS medical facility to BSNL/MTNL Pensioners.

 25-02.2016:    West Bengal Circle's Agitation. As a follow up action on the settlement reached on 16-2-2016, CTD administration issued order to all Addl GMs/DGMs.  READ THE CONTENT  
 22-02.2016:   78.2% ISSUE --- DRAFT FOR SECRETARY (T) NOT YET PREPARED: For informing the background of the case to the new Secretary(T), the draft note is still under preparation. Presently the file is with DDG(Estt) DOT. Let us see how many days the establishment section take to prepare the draft.
16-02.2016:   REASON FOR RETURNING 78.2% FILE  BY SECRETARY (TELECOM) : It is reliably learnt that Sri J S Deepak New Secretary(T) DOT, who has joined recently joined DOT, wanted to know the background and history of the case from Member( S) and Establishment Section of DOT. For that reason he returned the file yesterday to Member (Services) DOT instead of sending it to MOC for his approval.  
16-02.2016:   REMARKABLE VICTORY BY AIRBSNLEWA WEST BENGAL: As per the notice served, "SIT IN BEFORE CGM'S CHAMBER" was to be held on 17th Feb from 10 AM to 7 PM for settlement of long pending medical bills and other medical related issues of the pensioners. Today morning CGM called our AGS Com Amit Gupta and requested him not to hold the programme. It was pointed out to him that since issue of the notice, no discussion with the administration has taken place and now all pensioners are ready for the programme. Unless discussion took place and some firm commitment is received from the administration we cannot think of even defer the programme. CGM immediately acted and our circle secretary com Sitansu Sarkar received call from GM(HR & Admn) at 8.30 AM to attend the meeting on 12.00 PM at PGM CTD,s chamber.
At scheduled time Com D Biswas President, Com Sitansu Sarkar Secretary, Com Debabrata Roy Org Secretary and Com Amit Gupta AGS/CHQ went for the meeting. From management side Sh Apurba Kundu PGM, Sh S K Samanta GM (HR&Admn). Sh S Kujur GM (Finance) CTD were present. the meeting was held in very congenial atmosphere. All the harassments and sufferings faced by the pensioners to get their medical claims settled was highlighted. Management did not dispute any point and expressed their sorrow for the difficulties faced by the retired employees. Association wanted written time bound commitment to which management responded positively and assured in writing that all medical bills as on 29th February 2016 will be settled on or before 31st March 2016. The proposal of nominating one nodal officer at each area is also considered actively. They also requested to withdraw the agitation. In response to the written commitment, AIRBSNLEWA West Bengal has deferred both SIT IN on 17th Feb and SIT IN STARVATION from 22nd Feb till 31st March 2016. 15-02.2016:   78.2% FILE RETURNED BY SECRETARY (TELECOM) : Com Rakesh Srivastava enquired the status this morning with PS to Secretary(T). It is learnt that the draft cabinet memo has been returned by Secretary (T) to Member (Services) for some clarification.  
15-02.2016:    Agitation by West Bengal Circle : As per the notice served to CGM CTD, pensioners will stage "SIT IN" before CGM on 17th Feb and "SIT IN STARVATION" from 22nd Feb indefinitely. Since December 2015 management has issued as many as 7 orders to clear medical bills of the pensioners and to send a report by 10th Feb. As per the information only one area has submitted the report. Another order is issued on 11th Feb and also some SMSs. In spite of all these some areas are not bothered at all and some areas have taken some minor action which is insufficient to end the harassment of the pensioners. 10-02.2016:  78.2% FILE IS STILL WITH SECRETARY (TELECOM) : The file is still with the new Secretary (Telecom) as reported by his office today morning. It is also learnt that after joining to this new assignment, Sri J S Deepak, new secretary (T) has not cleared any file till date. Let us hope he will clear our case early.        
05-02.2016:    78.2% FILE IS STILL WITH SECRETARY (TELECOM) : Today evening it is lernt that the file is still with Secretary Telecom since yesterday. He could not see the file for other works. It is expected that Monday (8-2-16) he may clear the file.        
04-02.2016:    78.2% FILE SENT SECRETARY (TELECOM) : It is learnt from PS to Member (F) DOT that the final Cabinet Memo on 78.2% IDA merger and annulment  of 60% - 40% system has been sent to the Secretary Telecom this morning (04-02-16), After his approval the file will go to MOC and then to Cabinet Secretariet.

02-02.2016:    It is 11th day, the file is still with Member Finance DOT   Today also our President enquired about the status of 78.2% IDA merger file. It is learnt that the file with the final Cabinet Note is still pending with Member (Finance) DOT. None can say when she will clear the file. In earlier occasions also she took long long time to clear the file.

28.01.2016:   West Bengal Circle on Agitation. : AIRBSNLEWA WB has served notice today to the CGM CTD for agitational actions to end the stalemate on payment of Medical Bills. Earlier they issued two letters on 05-12-2015 and 15-1-2016 but no significant action has been taken to end the crisis. Outdoor Medical Claims of the pensioners are pending for more than one year and Indoor claims for 2-3 years. Due to such inaction more than 50% pensioners have stopped prefering their claims. The Demand Placed as below :

1)      Settlement of all outdoor and indoor claims submitted by 31st December 2015 within 15 th February 2016. Further the claims submitted by 31st January 2016 by 15 th March 2016 so on and so forth. (As per BSNL Order BSNL/Admn.I/30-6/15 dt 23-10-15)

2)      Supervision at every level to settle the disputed cases. For example the cases are pending at area level or the cases pending at CSC for final payment. There are many instances where the area has sent the approved bill for payment but payment is not made and the pensioner is shuttling between Hare Street and Area Office.

3)      Nominating one officer at every area as “Nodal Officer” to whom the pensioners will send their problems by SMS or Whatsapp. The Nodal Officer in turn will enquire the dispute and communicate back to the pensioner by SMS or Whatsapp. A second stage nodal officer be nominated at GM level to settle the disputes not settled at area. The name, designation and mobile numbers may be suitably notified.

4)      Suitable action by the management to bring back the confidence of the pensioners, so that they exercise their right and resume preferring medical claims.

Agitational Programme:

ü  “Sit in” before the chamber of CGM from 10 AM to 7 PM on 17-02-2016 for drawing the attention of the management.

ü   “Sit in Starvation” from 22-02-2016 before the chamber of CGM indefinitely till settlement of the demands.

      All members are requested to attend the programme punctually. This is a fight to establish the right of the pensioners. Inform all pensioners executive and non executive and solicit their support.

28.01.2016:   Meeting with Senior Officers of DoP&PW:

Com Prahlad Rai GS  AIBSNLEA and representatives of United Forum of MTNL unions & Associations Com. M.K. Bagchi and Com. A.K. Kaushik met the Senior Officers of DoP&PW today to discuss the future provisions of MTNL/BSNL pension revision. A Joint representation is also submitted. It is assured that DoP&PW is fully aware that DoP&PW is fully aware of this issue and necessary step will be taken with DoT . Read the Joint Representation.

28.01.2016:   Status of Cabinet Note on 78.2% IDA merger from 1/1/2007: Com Rakesh Srivastava President enquired the status. It is learnt that the file is pending with Member(Finance) DOT since last 5 days. It may get cleared today.
22.01.2016: Chief Patron Com Prahlad Rai and GS AIRBSNLEWA Com. Kishan Singh, Convener Forum of MTNL Unions & Associations Com. M K Bagchi met concern officers of DPE ( Department of Public Enterprise) and discussed regarding inclusion of IDA pension revision provision of BSNL & MTNL pensioners in 3rd PRC. It was confirmed that DPE has received a letter from DOT & our letter from Jt. Secretary (Cabinet) for taking up the issue with 3rd PRC as term and reference for BSNL/MTNL pensioners IDA pension revision. All it could happen due to our continuous persuasion with Secy. (T), Addl. Secy. (T) DOT, JT. Secretary (Cabinet) and DPE officers. DPE has now decided to take up the matter of BSNL/MTNL pensioners, IDA pension revision with 3rd PRC after its constitution. The 3rd PRC constitution proposal sent by DPE is pending in PMO for approval.
 

Further they also met senior officers of DOT and discussed regarding-

a)  78.2% IDA pay fixation case of BSNL pensioners- It is informed that legal opinion of law ministry has been received in DOT on Cabinet Note for 78.2% IDA pay fixation case of BSNL pensioners. Now DOT pension cell has moved the cabinet note to the competent authority for approval. It is understood that after the vetting of internal finance of DOT, the cabinet note will be approved by the Hon'ble MOC & IT and then it may be sent to cabinet for approval.

b)   IDA pension revision of BSNL/MTNL pensioners- It is informed that Admn. cell of DOT is taking up the case of IDA pension revision of BSNL/MTNL pensioners with implementation committee of secretaries of 7th CPC for consideration.

c)    CGHS medical facility to BSNL/MTNL pensioners- It was informed that Ministry of Medical & Health is yet to consider the case. Decision is awaited, though in principal Ministry of Medical & Health has agreed to extend the CGHS medical facility to BSNL/MTNL pensioners. 

21.01.2016:   Status of Cabinet Note on 78.2% IDA merger from 1/1/2007: Com Rakesh Srivastava President enquired the status. The file has come back from Law ministry to DOT. They have given their concurrence subject to the approval of DOP&PW and  DOE.

A. 78.2% IDA Pay fixation of BSNL Pensioners:

It was informed that the comments of Secretary (Law), Ministry of Law on the Cabinet Note on 78.2% IDA Pay fixation benefit to BSNL Pensioners are still awaited. After receiving the comments of Secretary (Law), the Cabinet Note will be sent to Cabinet Secretariat for consideration.

B. IDA Pension revision of BSNL / MTNL Pensioners:

They requested for taking up of the case of IDA Pension revision of BSNL / MTNL Pensioners with the Empowered Committee of 7th CPC for consideration. It is informed that DoT has already sent a letter to DPE for including as term of reference on this issue in 3rd PRC and they assured that shortly a letter will also be sent to the nodal officer of the Empowered Committee of 7th CPC for consideration of IDA Pension revision of BSNL / MTNL Pensioners.

It is understood that the matter has also to be taken up with DoP&PW to take-up the matter with Empowered Committee of 7th CPC for consideration of IDA Pension revision of BSNL / MTNL Pensioners who are governed under the Pension Rule 37-A which was notified by the DoP&PW. We will take-up the case with DoP&PW also shortly.

C. CGHS medical facility to BSNL / MTNL Pensioners:

It is informed that the Ministry of Medical and Health in principle has agreed to extend the CGHS medical facility to BSNL / MTNL Pensioners but on the issue of mapping of IDA Pay scales with CDA Pay scales, Ministry of Medical and Health wanted some clarifications from DoT which was also sent two months before and a reminder was also sent on 28.12.2015 in this regard. It is expected that Ministry of Medical and Health will issue the orders for extending CGHS medical facility to BSNL / MTNL Pensioners shortly.

14.01.2016:  "Family Picnic" organised by West Bengal Circle. On 13-1-2016 our West Bengal circle organised a family picnic at a picnic spot at Kolkata. Total 167 pensioners and their family members participated including 40 ladies. Sports events and Singing sessions were the added attraction. Delicious mouth watering breakfast and lunch was appreciated by all. Total programme was well organized. As a trend here also 5 pensioners are enrolled as life members of AIRBSNLEWA. 14.01.2016:  ABNORMAL DELAY IN SETTLEMENT OF MEDICAL CLAIMS OF THE PENSIONERS :On 4/1/2016 three representative namely kishan singh G.S, K.N. Mehra AGS(HQ)& Shri hardas singh batia met (GMA), BSNL Corporate office & give him the Letter regarding settlement of outdoor medical claim of pensioners. G.M(A) assured to issue a strong letter to all the Circles. click   
Our West Bengal Circle has also issued a letter addressed to CGM CTD and copy to GM(F) CTD again requesting him to clear all medical bills of the pensioners within one month. Click 
07.01.2016:  DPE issued order for 112.4% IDA from 1-1-2016. (107.9+4.5) = 112.4%    
07.01.2016:  We  congratulate CMD for his untiring efforts and proper presentation to ITAT(Income Tax Arbitration Tribunal) for refund of Rs.11,000 crores wrongly charged from BSNL  by IT department and to get rid of Rs.6000 crores IT liability further  imposed by IT Department on BSNL. WE also congratulate Dir(Fin), GM (bgt.) and their team who has played an important role which has to be appreciated by all.  It will help BSNL to refund  the bank  loan payments and some CAPEX,  it will also help BSNL  to get rid of the interest liability.     
05.01.2016:   Status of Cabinet Note on 78.2% IDA merger from 1/1/2007:   The file has been sent to Department of Law on 28-12-2015, It is expected that the file will be returned with their comment within 7 to 10 days.
05.01.2016:  Yesterday the office bearers of West Bengal Circle met with the senior officers of Calcutta Telephones and DoT Cell. They handed over the one page calendar of 2016 and set of writing pads brought out by them for the New Year 2016. Principal CCA and Joint CCA has taken keen interest to listen the problems mainly the 78.2% IDA merger issue and assured their support.

31.12.2015:   Our West Bengal Circle had earlier submitted a letter to CGM CTD highlighting the difficulties faced by the pensioners in getting settlement of their medical claims. It is also intimated that the pensioners will sit for hunger strike before the chamber of CGM if the issues are not resolved in a months time. Read the letter. In response to the said letter no of instructions have been issued.  one    two   three   four   five.   Unfortunately we are not finding any improvement and the suffering of the pensioners in spite of so many orders. Perhaps we are left with no other alternatives than to go for the agitation.    

30.12.2015:  PERSONS GUILTY OF CONCEALMENT OF FACTS FROM THEIR MEMBERS COUPLED WITH TOTAL INACTION AND OSTRICH LIKE  RESPONSE TO THE VITAL ISSUES OF PENSIONERS  WRONGLY  ACCUSE  OUR ORGANISATION/ OFFICE BEARERS OF SPREADING DISINFORMATION CAMPAIGN UNDER ARTICLE “ IS OUR PENSION SECURE?” AS PUBLISHED ON THEIR WEBSITE  ON 21/12/2015.

After HOLD-UP and delay in DoT in extending the benefit of 50% IDA Merger amounting to  78.2% IDA as on 01/01/2007, our AGS filed several RTI applications to DOT establishment and DOT finance to explore the cause of delay and expedite settlement of this issue. Based on the information received and supplied documents our CHQ Office bearers i.e. President / AGS   prepared several  write-ups which were  uploaded on  our website and these were very well received and appreciated by our colleagues/ comrades all over India.

Surprisingly a write-up has been uploaded in a website maintained by some persons, who claim to be the sole savior of BSNL pensioners but who never visited DoT Head Quarters or other concerned Offices/ Ministries to meet the concerned officers, over a period of last several years (no such news in their website),but  who still claim to be  dealing with  the present issues related to pensioners. As a result they are frequently not aware of the current status and only provide speculative/ hypothetical and many times incorrect information on their website just to impress their members and assure them that their interests are being looked after and protected. Incidentally these people were at the helm of the affairs at New Delhi as office bearers of TESA & AIBSNLEA when vital developments took place in DOT between 2000 & 2006 and they made all efforts to convince the members of TESA / AIBSNLEA with various arguments in most of their meetings to opt for absorption in BSNL without any reservations...............(Read the full write-up)   (Earlier write ups by our President  AGS)

23.12.2015:    PENSION REVISION IN BSNL & MTNL

A delegation comprising of S/Shri PrahladRai, GS/AIBSNLEA, Kishan Singh,GS/AIRBSNLEWA, Chandeshwar Singh, GS/NFTE(BSNL), Mange Ram Sharma, President / U.F, M.K.Bagchi, Convener/U.F, A.K.Kaushik, GS/TEAM and S.S. Nanda, GS/RTOWA,Delhi have met Shri N. Sivasailam, additional Secretary (T)/DOT to discuss the prospects of taking up the issue of the pension revision of the pensioners of BSNL and MTNL with the Empowered Committee constituted in connection with the recommendations of the 7th CPC. They have pointed out that even though 7th.CPC failed to make any reference of this issue in their recommendations, still there is a scope to take up this issue with the Empowered Committee through the Implementation Cell which DOT is supposed to constitute. This is apparent from the DO No.1-4/2015-EIII(A) dated 21.11.2015 of Ms Annie George Mathew, Jt. Secretary (Pers.), Min. of Finance, Deptt. of Expenditure.

 

Shri Sivasailam informs that DOT has already constituted its Implementation Cell with Shri S.C.Sharma, DDG/CA as the Nodal Officer. He has assured us of taking up this issue appropriately with the Implementation Cell of DOT.

23-12-2015:   Status of Cabinet Note on 78.2% IDA merger from 1/1/2007: Required note for sending the file to the Law Ministry has been prepared by the Esablishment Cell of DOT and now approval of Member(S), Member (F) & Secretary DOT will be taken. After that the file will come back to Establishment section for sending it to Law Ministry.     

19.12.2015:  Meeting with Shri N Sivasailam, Addl. Secretary (T), DoT:

Com Prahlad Rai and Com. M.K. Bagechi, Convener, United Forum of MTNL Unions & Associations  met Shri N Sivasailam, Addl. Secretary (T), DoT and handed over a joint representation for inclusion of pension and related issues of BSNL & MTNL in the terms and reference of 3rd PRC   <<<Click here for letter>>> and requested him to send a letter to the Cabinet Secretary with a copy to Secretary, DPE in this regard.

AST appreciated their concern and immediately directed on the letter itself to the concerned cell of DOT to send a letter to the Cabinet Secretary / Joint Secretary, Cabinet Secretariat Shri Alok Chaturvedi and Secretary, DPE in this regard and mentioned that the work is done.

They extended sincere thanks for his immediate action.

 

Yesterday evening at 15.30 Hrs;  the representatives of AIBSNLEA and United Forum of MTNL Unions & Associations also met  the concern officers of Cabinet Secretariat in this regard.
 

The delegation of BSNL and MTNL comprising of S/Shri Prahlad Rai, GS/AIBSNEA & Chief Advisor AIRBSNLEWA, M.K Baghci, convenor /united Forum of MTNL Unions & Associations , A.K Kaushik, GS/Team and Rajeev Kumar, AGS/TEAM have met Shr  Alok Chaturvedi , Jt Secretary, Cabinet Secretariats  on 18-12-2015 and handed over a Jt. representation  for inclusion  of the pension and related issues of BSNL and MTNL in the Terms and reference of 3rd PRC. 17.12.2015:   West Bengal Circle has published 2nd issue of their House Journal AIRBSNLEWA VOICE. As the main article is in Bengali read its English Version  along with other items of the Journal.   

16.12.2015:  Meeting with Shri Rakesh Garg, Chairman (TC) and the Secretary (T), DoT on Revision of Pension in BSNL & MTNL:  Com Prahalad Rai Chief Patron, Com. Kishan Singh, GS, AIRBSNLEWA and Com. M.K. Bagechi, Convener, United Forum of MTNL Unions & Associations,  met Shri Rakesh Garg, Chairman (TC) and the Secretary (T), DoT and discussed regarding implementation of 78.2% IDA fitment benefit to BSNL Pensioners, withdrawal of 60:40 provision, and to take up with DPE to include the issue of Pension revision of BSNL/MTNL pensioners immediately in the terms and reference of 3rd PRC. Secretary (T) appreciated the concern and mentioned that the Cabinet Note on 78.2 % IDA fitment benefit to BSNL Pensioners has been finalized in DoT and now being sent to the Ministry of Law for legal clearance since earlier on the Cabinet Note the legal opinion / comments were given at lower level and now since the Cabinet Note will go to cabinet, Secretary (Law) comments are necessarily required. He assured as soon as the legal clearance is received, the Cabinet Note will be sent to cabinet for approval. On 60:40 withdrawal issue Secretary (T) categorically told that DoT will get removed this provision through this Cabinet Note from cabinet. Regarding the issue of Pension revision of BSNL/MTNL pensioners Secretary (T) appreciated the concern and advised to give a letter in this regard. They immediately drafted a letter signed by them and handed over to Secretary (T) in person which he immediately marked to Addl Secretary (T), DoT to take up the matter with DPE for inclusion of this issue in the terms and reference of 3rd PRC   <<<Click here for letter>>>

14-12-2015:   Status of Cabinet Note on 78.2% IDA merger from 1/1/2007:  Com Rakesh Srivastava President enquired the status today morning. It is learnt that the file, which was sent upwards by Director (Esablishment) DOT for onward transmission to DOE or Cabinet, has come back to him with some notes of the legal advisor DOT.
13.12.2015: The Status of 206 Seniority case in Hon'ble Supreme Court: The 206 seniority case along with the experts committee report came up before Hon'ble Supreme Court 0n 11-12-2015. The case is now posted for hearing to 16.02.2016 along with 147 case.
04-12-2015:   Status of Cabinet Note on 78.2% IDA merger from 1/1/2007:  Com Rakesh Srivastava President enquired the status today. It is learnt that DOT Establishment has prepared the reply to the points raised by Department of Expenditure for sending it to DOE. They have also modified the draft Cabinet Note accommodating the questions of DOE and the replies. Both are now put up to Member (Services) DOT for approval. As per the decision either the reply will be sent to DOE or modified Cabinet Note will be sent to the Cabinet. Actual Status will be known by middle of next week.

Yesterday Com Kishen Singh GS and Com Prahlad Rai Chief Patron met  GM (CIT) and GM (Admn) BSNL regarding enhancement of free call limit and linking with ERP of BSNL Pensioners medical claims.  GM(CIT) further assured to examine the case and favorable action to link with ERP and GM (Admn) informed the proposal to enhance the free call limit has been sent to Sr.GM(Legal) to get approval from BSNL Management Committee. They assured an early action in this regard. Earlier they also met Director (Staff) DOT and discussed 78.2% IDA and CGHS facility to BSNL Pensioners issue.
 03-12-2015:   ANNUAL MEET (BIJOYA SANMILANI) OF WEST BENGAL CIRCLE : On 2-12-2015 our West Bengal State Branch held their annual get together cum Bijoya Sanmiloni at CTO Hall Kolkata. 400+ pensioners attended the meeting including 57 non members. Amongst the non members 41 pensioners immediately enrolled themselves as Life Members and remaining pensioners assured to take the membership later. Com K K Das CS Assam Circle AIRBSNLEWA was present in the meeting and gave his address. Com Prasun Mukhopadhayay CS AIBSNLEA CTD  was also present , In his address he assured his support to settle the medical bill problem of pensioners and also the 60:40 issue. Com D Basu Circle Secretary CORTO also attended and deliberated. Com Sitansu Sarkar State Secretary gave a brief account of activity of this Association. Com Amit Gupta explained the pension issue in detail before the house. There after a cultaral programme was followed with songs recitations etc. The meeting continued from 2 PM to 6 PM.
